STAFF REF-ORTS: COMMUNITY, D,EVELOPME.NT,DIRECTOR'S,,,,,REPORTS AND RECOMMENDAILQN�j: Community Development Director Aguilera reported on correspondence by Brother Eugene Dougherty from APAC Christian Mission, who requested a waiver of fees totaling $ 2,360.00 for a conditional use permit for carnivals held on July 10-12 and July 17-19, 1992 at Plaza Las Glorias. Mr. Dougherty requested waiver of fees for future carnivals, expected to be three per year, potential fees would be approximately $3,540.00. Finally, Brother Dougherty proposed a waiver of fees for a carnival to be set up for one day to allow a free_�ay for abused children in emergency shelter homes and in foster homes, To date, Mr. Dougherty has paid all fees. Mr. Aguilera referred to the City Municipal Code, specifically Sections 5.02-530 and 5.02.480, gj Mg., which direct that py"r person conducting business under these sections ,shall pay the certain license tax. There are n I no provisions for a waiver of fees. Staff recommended denial of Brother Dougherty's and APAC Christian Mission's request for waiver of any and all fees, pursuant to applicable law. Brother Eugene Dougherty, Executive Director and Founder of APAC Christian Mission located at 1226 North Mt. Vernon, stated the non-profit religious corporation provides services to battered and abused parents with a child or children and other children's services. He angrily reported that Mr. J. C. Washington, City Code Enforcement Officer, had assured him "he did not have a chance in hell of getting it passed." He called Reverend C. A. Simpson for further presentation. Rev. Simpson, Pastor of a San Bernardino Baptist Church, remarked he understood the ordinance but felt there can be exceptions. He described their ministry in aiding abused children. He thanked the City Council for their attention and asked them to consider this request for help with their plight. Motion by Councilman Lofy, seconded by Councilman Rehrer, to accept Staff recommendation, Unanimous vote, Mayor Gonzales clarified that the motion was a denial of the request.
