D!Qmolition..gf Strjj!gturg_s <br />(This Item continued to next meeting.) <br />STAFF REF-ORTS: <br />COMMUNITY, D,EVELOPME.NT,DIRECTOR'S,,,,,REPORTS AND RECOMMENDAILQN�j: <br />Community Development Director Aguilera reported on correspondence by Brother Eugene <br />Dougherty from APAC Christian Mission, who requested a waiver of fees totaling $ 2,360.00 <br />for a conditional use permit for carnivals held on July 10-12 and July 17-19, 1992 at Plaza <br />Las Glorias. Mr. Dougherty requested waiver of fees for future carnivals, expected to be <br />three per year, potential fees would be approximately $3,540.00. Finally, Brother Dougherty <br />proposed a waiver of fees for a carnival to be set up for one day to allow a free_�ay for <br />abused children in emergency shelter homes and in foster homes, To date, Mr. Dougherty <br />has paid all fees. <br />Mr. Aguilera referred to the City Municipal Code, specifically Sections 5.02-530 and <br />5.02.480, gj Mg., which direct that py"r person conducting business under these sections <br />,shall pay the certain license tax. There are n I <br />no provisions for a waiver of fees. <br />Staff recommended denial of Brother Dougherty's and APAC Christian Mission's request for <br />waiver of any and all fees, pursuant to applicable law. <br />Brother Eugene Dougherty, Executive Director and Founder of APAC Christian Mission <br />located at 1226 North Mt. Vernon, stated the non-profit religious corporation provides <br />services to battered and abused parents with a child or children and other children's services. <br />He angrily reported that Mr. J. C. Washington, City Code Enforcement Officer, had assured <br />him "he did not have a chance in hell of getting it passed." He called Reverend C. A. <br />Simpson for further presentation. <br />Rev. Simpson, Pastor of a San Bernardino Baptist Church, remarked he understood the <br />ordinance but felt there can be exceptions. He described their ministry in aiding abused <br />children.
