La Cadena Drive Beautification <br />Project and the AT&.BF Bridge located at South La Cadena at Congress, <br />RESOLUTION LUTION NO. R-11-9 . <br />{7} Claim <br />Denial of Claire of Barbara Battle. <br />Motion by Councilrnernber Cisneros, ,seconded by Councilrnember Sandoval, to <br />approve and accept the Consent Calendar. Unanimous vote. <br />PUBLIC HEARIN95 <br />File lndex,Number D071-03 <br />Mayor Gonzales announced that this was the Time and Place Fixed for Public Hearing <br />on File Index Number Dpi -1-93 to Consider an Amendment to Section 18.06.060 of <br />the Colton Municipal Code Pertaining to Permitted Uses. <br />Mayor Gonzales declared the Public Hearing open. <br />City Clea Ramos submitted the ,affidavit of Publication and reported that no protests <br />or objections were received. <br />Community Development Director Zamora recalled the City Council had directed the <br />Community Development Department to undertake a study to consider allowing <br />composting, mulching and related green waste and other related uses in specified <br />zones, upon issuance of a Conditional Use Permit, to achieve compatibility between <br />land uses. The proposed teat amendment will allow composting in I'll -1 (Light <br />Industrial) and M- (heavy Industrial) zones with an approved Conditional Use Permit <br />by the Planning Commission. Definition of "Composting" is part of the amendment. <br />Mr. Zamora said that the Planning Commission approved the proposed amendment <br />with the addition of allowing composting in the Agricultural Zone with approved <br />Conditional Use Permit. He reported that Attorney Schultz who represented Mr. <br />Charles Paul had questioned whether this was in compliance with the California <br />Environmental Quality Act {CE A} and Deputy City ,attorney Biggs had provided legal <br />opinion that the proposed amendment is not a project and therefore exempt from the <br />process. Staff recommended City Council approval of the proposed amendment. <br />Attorney Charles Schultz, from Reid & Flellyer in Riverside, who represented Mr. Pauls <br />stated they agreed with the Planning Commission determination on composting with <br />a conditional use permit within an agricultural zone.
