Community Development Director Zamora reported that at a joint City/School <br />meeting, approximately two months ago, Dr. Fischer informed that the school has a <br />policy which addresses what is being proposed: If a student is caught doing graffiti, <br />he/she may face expulsion or suspension from school. <br />Councilmember Sandoval asked that subsection "C" of Section 9.27.040, found on <br />Wage 7, be deleted. He believed that at the secondary school level, the graffiti <br />materials should be confiscated. Councilmember Cisneros argued that if the student <br />has a legitimate reason for carrying such materials to or from school - for poster or art <br />work - that it should be allowed, Councilmember Sandoval informed that now such <br />materials are supplied in school and the school teachers and administrators direct the <br />students to beep possible graffiti materials at home. <br />Councilmember Beltran voiced the fact that everyone on the task force committee had <br />corked hard on the proposal and urged passage of First Reading. Deputy City <br />Attorney Biggs advised that approval of first reading may take place today and any <br />suggested changes can be contemplated at second reading. <br />Mr, Richard Prieto stated that naggers needed to be punished to the full extent of the <br />later. He suggested that we ( 1) find the limit of the lav that can be applied to the <br />kids; (2) publish parents names and addresses; () charge for time spent by law <br />enforcement and other city officials; (4) ask for for one year probation where the <br />defendant is sentenced to stay indoors from sunset to sunrise unless accompanied by <br />a parent; (5) tag the taggers with different colors plastic bands; and, (B) Create a <br />coalition of cities to help with the system. He urged that the City create graffiti <br />awareness amongst the citizens. <br />Deputy City Attorney Biggs warned that disclosure of children's names violated the <br />private rights of the minors. She ,advised that State law addressed many of the issues <br />raised. The City can mare some laws but they cannot conflict or duplicate those <br />laws. As to tagging minors, she advised that the disclosure of a minor's identification <br />is prohibited under the law. Any disclosure of identification is a violation of the state <br />law. Any changes in the law need to be ;Wade through Senator Ayala at the State <br />level, She stated that the proposed ordinance reflected the constraints and is in <br />accordance with state lave and will not be preempted. Requested by Councilmember <br />Sandoval, Deputy City Attorney Biggs agreed to draft a resolution outlining the ideas <br />expressed to forward to Senator Ayala. <br />Mr. Fred Cordova suggested that the City Council may want to contact Congressmen <br />Baca and Aguirre who are very active in this area. <br />Motion by Councilmember Beltran, seconded by Councilmember Cisneros, to close the <br />public hearing carried.
