Councilmember Cook stated she is the one that has some very <br />important projects on held pending this person coming on board and <br />she would, like to have the problem ironed out; however, she would <br />ask that the Council act on this no later than September 21, 1993. <br />Upon roll call vote motion carried. Councilmembers Bennett, <br />Sandoval and. Mayor Gonzales voting "NO". <br />. <br />Item 10 <br />Mr. Michael Lynd, San Bernardino Public Employees Association <br />Representative, addressed the City Council with respect to <br />proposed Resolution No. R-91.93, authorizing temporary part-time <br />employees to be considered for appointment to regular part-time and <br />full -tame positions following 1,000 hours of satisfactory service. <br />Mr. Lynd stated that it appears as though, this proposal is a <br />vehicle to circumvent the filling of positions through the <br />competitive process and it is unfair to all those employees who <br />have obtained their positions after going through the examination <br />process. Under the proposal it would be passible to take anyone <br />off the street, assign that person to a part-time position and <br />after 1,000 hours g1ft the person with a permanent position. This <br />discourages all qualified people from open competition because it <br />has the appearance of bringing people in through the back. door. <br />The Council would be condoning dual criteria for its employees and <br />this could have an adverse of f ect on of f irmati.ve action. There are <br />some serious concerns that this would not be fair and equal <br />treatment and would encourage pre -selection. fir. Lund closed by <br />saying the Association would, like an opportunity to meet and confer <br />on this matter. <br />Magor Gonzales stated that the intent of the resolution was to <br />solve a problem that part time employees have Faced for a long <br />time. There are some employees that have been part time for five <br />or six years. They have been overlooked by the present system. <br />These employees were at one time on an eligibilty hist. The list <br />gets purged periodically and a new list is established. is it fair <br />to these employees to have to retest continuously. These employees <br />have paid their dues. The Council would like to afford, these <br />employees with benefits and labor organizations should want to do <br />the same. <br />Councilmember Sandoval stated the part time employees do not have <br />any respresentation and he did not understand why this matter <br />should be held up. <br />Mr. Lynd stated the association does not have a problem with <br />temporary assignments; however, when it comes to filling a. <br />permanent full time position, it should not be gifted, it should be <br />opened up to give every qualified person an equal opportunity. <br />Councilmember Sandoval stated in this resolution we are looking to <br />P <br />
