Municipal Code Establishing Requirements For The Review Of Land To Be Used As Open <br />Space Mitigation For Species Conservation <br />Mayor Chastain declared the public hearing open. <br />City Clerk Padilla announced that the Notice of Continuance for the public hearing was on file in <br />the City Clerk's office and two protests or objections have been received. <br />City Attorney Martinez explained that this item had been continued from prior meetings, the last <br />two items are presented for consideration, the last ordinance is the same as the urgency <br />ordinance but it is not an urgency, staff is requesting to adopt an ordinance to repeal the <br />Urgency Ordinance 0-26-06 as direct by the courts, and postpone any action on the other two <br />ordinances as staff continues to work with the Fish and Wild Life and other. parties. Staff <br />recommends the adoption of the first ordinance on the agenda and the removal of the other two <br />ordinances on the agenda. <br />PUBLIC COMMENT: <br />Rex Johnson, did not support the item before council. <br />Motion/second by CM De La Rosa/Suchil to close the public hearing. Motion carried. <br />Discussion continued with motion/second by CM Oliva/De La Rosa to approve and adopt <br />Urgency Ordinance 0-02-07 repealing Ordinance 0-02-06. Motion carried. <br />Motion/second by CM Oliva/Suchil to table Urgency Ordinance 0-01-07. Discussion continued <br />with CM Mitchell asking for clarification if no vote to table and whether it could be brought back if <br />tabled repealing Ordinance 0-02-06, City Attorney Martinez explained that it would show that <br />City is being cooperative and it could be brought back at another meeting.
