1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, based on Staff's calculations, a total of 186 parking spaces <br />would be required to ensure sufficient parking, in accordance with the City's Zoning <br />Ordinance, for the entire Project; and <br />WHEREAS, City Staff agreed with Applicants that because the <br />Nightclub Area and the Retail/Office Area are intended to be utilized at different <br />times of day, some of the parking needed for the Nightclub Area could be provided <br />by the parking required for the Retail/Office Area, and vice -versa; and <br />WHEREAS, the only provision of the Zoning Code that takes into <br />account nighttime and daytime use of parking is the provision set forth in Section <br />18.36.040(A) regarding joint use of parking facilities, which provides that up to fifty <br />percent of the parking facilities considered to be primarily a daytime use, may be <br />provided by a use considered to be primarily a nighttime use, and vice -versa; and <br />WHEREAS, despite the fact that the Project does not propose joint use <br />of parking facilities, City Staff agreed to apply Section 18.36.040(A) in order to allow <br />for a reduction of the total number of parking spaces required for the Project, for a <br />revised total of 154 spaces; and <br />WHEREAS, Applicants also requested a Minor Variance, pursuant to <br />Section 18.58.030(C)(1)(h) of the Zoning Code, which allows for up to a ten percent <br />(10%) reduction of the required parking spaces; and <br />-3- <br />
