1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, after applying the Minor Variance to the revised total of <br />154 spaces, City Staff determined that 139 spaces, including five (5) handicapped <br />spaces, would be required for the Project; and <br />WHEREAS, the Application proposes only 111 parking spaces, with <br />two (2) handicapped spaces, thus the Project does not meet the City's Zoning Code <br />requirements for parking; and <br />WHEREAS, because the Project does not provide adequate parking as <br />required by the Zoning Code, vehicular parking and circulation on the site will create <br />safety hazards; and <br />WHEREAS, although the proposed project site is the West Valley <br />Specific Plan (East Subarea) with a land use designation of "Mixed Use" and the <br />Project does comply with this land use designation, there is an established <br />neighborhood located to the west of the Subject Site; and <br />WHEREAS, access to the Project will necessarily be through streets that <br />run through this existing residential neighborhood; and <br />WHEREAS, City Staff has reviewed the Institute of Traffic Engineers <br />Manual ("ITE Manual") Trip Generation, 7th Edition, and has determined that up to 74 <br />peak hour trips could be generated by the Nightclub Area; and <br />WHEREAS, the sale of alcohol for on-site consumption on the proposed <br />nightclub premises may be detrimental to the health, safety and/or welfare of the <br />-4- <br />
