Portions of the Site, particularly the dunes to the north, are designated as Delhi Sands <br />Flower -Loving Fly (Fly) habitat. The U.S. Department of Fish and Wildlife Services has <br />designated the Fly as an endangered species. <br />CalMat Land Company currently owns the property, which is approximately 160 acres. <br />On August 31, 1988, CalMat Land Company entered into an agreement with California <br />Portland Cement, giving California Portland Cement the right to store waste rock at the <br />Site. The duration of the agreement was ten years. A copy of this agreement is <br />included in Exhibit A. <br />2.4 Descriptions of Structures, Roads and Other Improvements on the Site <br />The Site is currently vacant. A small, corrugated, metal shed was the only structure <br />observed onsite. Two sets of power lines run north/south through the property.
