LAFCO 2681 <br />CONDUCTING AUTHORITY - INFORMATION SHEET <br />Attached is the LAFCO Resolution approving the proposal for which <br />your jurisdiction has been named the "Conducting Authority". In <br />order to complete this proposal the jurisdiction should conduct <br />further proceedings with or without notice or hearing as outlined in <br />the resolution and in accordance with the Cortese/Knox Local <br />Government Reorganization Act. <br />1. If further proceedings on the action require a Noticed Public <br />Hearing, please follow these procedures: <br />a. NOTICE OF HEARING <br />The Clerk of the conducting authority (for Cities, the <br />City Clerk) shall set the proposal for hearing and prepare <br />the "Notice of Hearing". The date of the hearing can be <br />"no less than 15 days nor more than 60 days" from the date <br />the Notice of Hearing is published. (Section 57002 of the <br />Government Code) <br />b. The Notice of Hearing shall be mailed, published, and <br />posted pursuant to the provisions of Government Code <br />Section 57025 and 57026. In part these sections indicate <br />that mailed notice is to be provided to "..each affected <br />district, affected county, the Commission (LAFCO), the <br />chief petitioners.." <br />C. Govt. Code Section 56161, effective January 1, 1989, <br />indicates that in the case of a proposed annexation to a <br />City consisting of 75 acres or less, "..the city shall <br />mail, pursuant to Sections 56155 to 56157, inclusive, to <br />each landowner within the affected territory, notice of <br />the conducting authority hearing.." This is in addition <br />to the mailed notice outlined in Section b above. <br />d. Govt. Code Section 57026 (g) and (h) in part indicates <br />that landowners and registered voters "..may file a <br />written protest against the proposal with the clerk of the <br />conducting authority at any time prior to the conclusion <br />of the hearing..." <br />e. Further action of the conducting authority relating to <br />protest provisions, conduct of hearing, etc. are outlined <br />beginning with Govt. Code Section 57050. <br />2.
