RESOLUTION NO. R-35-94 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON DECLARING <br />ITS INTENTION TO FORM THE RANCHO MEDITERRANIA PUBLIC IMPROVEMENTS <br />ASSESSMENT DISTRICT WITHIN THE CITY OF COLTON. <br />RESOLVED, by the City council of the City of Colton ( the <br />"City"), that: <br />WHEREAS, the City Council (the "CityCouncil")of the City of <br />Colton, California, desires to express its intention to form an <br />assessment district to be known and designated as Rancho <br />Mediterrania Public Improvements Assessment District (the <br />"Assessment District") for the acquisition of certain roadway, <br />drainage and related improvements and the acquisition of necessary <br />land, easements and rights-of-way, together with appurtenances and <br />appurtenant work in connection therewith and incidental costs and <br />expenses, all as more particularly described in Exhibit "A" <br />attached hereto and incorporated herein by reference (the <br />"Improvements"), pursuant to the provisions of Division 12 of the <br />Streets and Highways Code of the State of California commonly <br />known as the "Municipal Improvement Act of 1913" (the "Act"), with <br />bonds to be issued to fund and finance said Improvements pursuant <br />to the provisions of the "Improvement Bond Act of 1915" (the "Bond <br />Act"), being Division 10 of said Code; and <br />WHEREAS, it is necessary to appoint an engineer to prepare the <br />report required by Streets and Highways Code Section 10204 and <br />perform other engineering services necessary to said proceedings in <br />the capacity of Engineer of Work, and Site Design Associates, Inc., <br />is an engineering firm skilled in the performance of such <br />engineering services and has submitted a written proposal covering <br />their performance of professional engineering services on behalf of <br />the owners of property within the Assessment District; and <br />WHEREAS, it is the opinion of the City Council that the public <br />interest and convenience require that the acquisition of the <br />Improvements be ordered, and the Council therefore proposes to form <br />the Assessment District under the provisions of the Act for the <br />acquisition of the Improvements on behalf of the properties within <br />the proposed Assessment District; and <br />
