1 evidenced by such publication of the Notice of Intention to Sell <br />2 Bonds. <br />3 <br />4 SECTION 4. Modification and Withdrawal. Each of the <br />5 Director and the Treasurer may withdraw or modify the Notice Inviting <br />6 Bids and the Notice of Intention to Sell Bonds, or either, at any time <br />7 by notice published via Munifacts wire or other means determined by <br />8 the Director or the Treasurer to be reasonably calculated to reach <br />9 potential bidders for the Bonds. If the Director or the Treasurer <br />10 should withdraw the Notice Inviting Bids and the Notice of Intention <br />11 to Sell Bonds at any time before the Bonds are awarded, and should at <br />12 a later date determine that it is desirable to receive bids for the <br />13 Bonds, then the City Clerk is hereby authorized to redistribute or <br />14 republish the Notice Inviting Bids and the Notice of Intention to Sell <br />15 Bonds with such modifications or revisions as are approved by the <br />16 Director or the Treasurer. <br />17 <br />18 SECTION 5. Preliminary Official Statement. Each of the <br />19 Director and the Treasurer is hereby authorized to approve a <br />20 Preliminary Official Statement relating to the Bonds (such approval to <br />21 be conclusively evidenced by the delivery thereof) (the "Preliminary <br />22 Official Statement") and the City Council hereby approves the use of <br />23 the Preliminary Official Statement in connection with the offering and <br />24 sale of the Bonds. The Director and the Treasurer are each authorized <br />25 to deem the Preliminary Official Statement to be final within the <br />26 meaning of Security and Exchange Commission Rule 15c2-12 subject to <br />27 the completion of those items permitted by said Rule. <br />28 <br />3 <br />
