The amount of energy scheduled by City, for each hour that City's <br />e�lergy schedule is less than or equal to Edison's energy schedule; or <br />b. T'he amount of energy scheduled by Edison, for each hour that City's <br />energy schedule is greater than or equal to Edison's energy schedule. <br />The firm transmission service rates set forth in the Edison-Colton <br />199� Sart Juan Unit 3 Firm Transmission Service Agreement between <br />Southern California Edison Company and City of Colton shall not be applied. <br />2. Der�tand Chargg� <br />San Juan Unit 3 shall not be a source of Rated Capability and shall not reduce <br />City's billing demand. City shall pay Edison the most current demand charges <br />in a�cor�dance with the partial requirements rates established in FERC Rate <br />Sch�dul�e 31. San Juan Unit 3 shall not be treated as a City Capacity Resource. <br />3. Energ��'har <br />For eacri hour that City schedules a greater amount of San Juan Unit 3 energy <br />on its Resource Accounting Schedule than Edison schedules into Edison's <br />Control Area, City shall pay Edison for the difference between scheduled <br />amaunt;� at the most current partial requirements energy charge set forth in <br />FERC R�ate Schedule 31, including the applicable fuel cost adjustment billing <br />fact<�r. <br />For eacri hour that Edison schedules a greater amount of San Juan Unit 3 <br />energy into its Control Area than City schedules on its Resource Accounting <br />Sch�dul�, Edison shall pay City for the difference between scheduled amounts <br />at City's Point of Attachment City Incremental Cost for San juan Unit 3. <br />For eac� hour that City schedules San Juan Unit 3 energy on its Resource <br />Accc�un�ing Schedule and Edison schedules the same amount of San Juan <br />Unii: 3 emergy into its Control Area, such energy shall be treated as Non-Firm <br />energy in accordance with the Supplemental Agreement for the Integration of <br />Non.-Fir�n Energy Purchased under the WSPP Agreement. <br />If Edison ulcurs any liabilities, charges, or damages, or suffers any other losses of any <br />kind (includin� without limitation direct, indirect or consequential loss, liability, <br />charge, damag�e, claim, cost, or expense) as a result of its agreement to commence <br />service prior tc� FERC acceptance for filing, then City shall indemnify Edison for all <br />such losses, to the maximum extent permitted by applicable law.
