<br />Release Agreement.
<br />City Attorney Hutton advised that the City has received a payment in the amount of $32,000 from
<br />the Travelers Indemnity Company on behalf of Washington Bluffs, a limited partnership, regarding
<br />an agreement whereby Washington Bouffs was to perform the construction of a storm drain at or
<br />near the intersection of State Highway 395 and Washington Avenue in the City of Colton, which has
<br />never been accomplished.
<br />Mr. Hutton said this has been accomplished through the efforts of Mr. Earl Young and himself.
<br />Mr. Young stated he felt this money should be set aside and earmarked for a future storm drain
<br />in the vicinity mentioned.
<br />On motion of Councilman Rehrer, seconded by Councilwoman Spragins and unanimously passed, Council
<br />approved earmarking $32,000 received from The Travelers Indemnity Company for a future storm drain
<br />to be located at or near the intersection of State Highway 395 and Washington Avenue in Colton.
<br />CITY MANAGER REPORTS AND RECOMMENDATIONS:
<br />City Manager Huffaker stated the Council members have received a memorandum and bid summary to
<br />provide five vehicles, including two 1 ton flatbed trucks and three 3/4 ton pickups.
<br />Mr. Huffaker said the bids have been analyzed and Staff recommends the purchase of these vehicles
<br />from Center Chevrolet in the amount of $23,177.50, and further recommend the vehicles to be re-
<br />placed be sold by a bidding procedure.
<br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed, Council
<br />approved awarding bids for five vehicles to Center Chevrolet in the amount of $23,177.50.
<br />Salary increases for certain temporary positions in accordance with Minimum Wage Law.
<br />City Manager Huffaker advised that amendments to the Fair Labor Standards Act took effect May 1,
<br />1974, which means federal, state, and local government employees have been brought under the Act's
<br />minimum wage overtime and equal pay providions. Public empllyees have also been brought under
<br />the coverage of the Age Discrimination Law.
<br />Mr. Huffaker said it is not known at this time all of the ramifications of the new law, and com-
<br />plete copies of the legislation are still not available.
<br />Mr. Huffaker continued that as of May 1, 1974, the new law effects several of the City's temporary
<br />positions, Library Page, Police Matron, Crossing Guard, and Groundskeeper, bringing them up to
<br />$1.90 per hour.
<br />Mr. Huffaker stated that as of January 1, 1975,
<br />on January 1, 1976 it will go to $2.20 per hour,
<br />per hour.
<br />the minimum wage will increase to $2.00 per hour,
<br />and on January 1, 1977 it will go up to $2.30
<br />Mr. Huffaker said that a resolution has been prepared covering the temporary salaries effected
<br />for our City's positions, and Minute Action is also necessary from the Council regarding the
<br />hours and overtime for the Refuse Department, which need to be changed from 48 hours per week to
<br />40 hours per week, with overtime being paid for time over the regular 40 hours.
<br />On motion of Councilwoman Spragins, seconded by Councilman Gonzales and unanimously passed, Resolu-
<br />tion No. 3428 was approved:
<br />RESOLUTION NO. 3428 - AMENDING RESOLUTION NO. 3352, TEMPORARY EMPLOYEES SALARIES.
<br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed, Council
<br />approved authorization of overtime pay for miscellaneous employees for time over and above 40 hours
<br />per week, in accordance with Fair Labor Standards Act.
<br />Transferring of the Cemetery and Parks Divisions to the Department of Public Works and the estab-
<br />lishment of a Parks and Cemetery Superintendent.
<br />Councilman Gonzales stated he would like to make a few comments on this item and would like to
<br />point out the fact that in the process of this transition, one of our department heads is being
<br />demoted, and he does not think it is fair or right.
<br />Mayor Huntoon asked Councilman Gonzales if the City Manager could make his presentation first,
<br />and -the Council could comment and ask questions afterwards.
<br />City Manager Huffaker read from his memorandum to the City Council, dated May 3, 1974, as follows:
<br />The administrative staff has been considering the streamlining and reorganization of the Department
<br />of Public Works. The reorganization would also include combining the two divisions of Parks and
<br />Cemetery into one division, the Parks and Cemetery Division, and transferring it to the Department
<br />of Public Works. It was the Staff's feelings that the entire reorganization would be submitted
<br />to the Council for its consideration during this year's budgetary process. However, due to the
<br />recent resignation of the Cemetery Superintendent, it is felt the transferring of the Parks and
<br />Cemetery Divisions is appropriate at this time.
<br />For the Council's information, both the -Parks and Cemetery Divisions rely heavily on the cooperation
<br />and coordination of the Streets Division and the Water Division of the Department of Public Works.
<br />It is felt, by placing the Cemetery and Parks Divisions under the control of the Director of Public
<br />Works, the coordination can be accomplished in a more efficient manner. To effect the orderly ad-
<br />ministration of the division and to assure responsiveness and accountability, we are recommending
<br />the establishment of a Parks and Cemetery Superintendent. His duties are spelled out in the attached
<br />class specifications. In addition, we are recommending that the Parks Superintendent's title be
<br />changed to Parks Foreman and the Cemetery Superintendent's title be changed to Cemetery Foreman.
