<br />that the City of Colton designate their Voting Representative and an Alternate Voting
<br />Representative for the annual League Conference, to be held in Los Angeles from October 20
<br />through 23, 1974.
<br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and passed, Council
<br />designated Mayor Huntoon as the Voting Representative and Councilman Rehrer as the Alternate
<br />Voting Representative to the Annual League Conference for the League of California Cities.
<br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS:
<br />Report on sidewalk waiver request of Mr. Donald Rogers.
<br />Planning Director Williams stated this request involves the waiver of off-site improvements
<br />by Mr. Donald Rogers for Tract No. 6610 in Reche Canyon.
<br />Mr. Williams said. the Council members have copies of Mr. Rogers' original letter and a copy
<br />of Staff's report.
<br />Mr. Williams reported that Staff has looked at some of the problems involved with this sub-
<br />division, especially those pertaining; to sidewalks for this tract. Mr.. Williams said there
<br />are no sidewalks in this subdivision, and one side of the s treet, ,the west side, contains
<br />curb and gutter, while the other side of the street, the east side, has asphalt berm.
<br />Mr. Williams said that Staff feels a minimum 30 foot curb to curb distance be made available
<br />to provide access so that if cars are parked on both sides of the street, the 30 feet would
<br />leave room for an automobile .or fire truck to pass.
<br />Mr. Williams advised that sidewalks could be installed on the east side of the street but
<br />would require one owner, Mr. Rogers, to install 485 feet of sidewalk, and installation of
<br />sidewalks on the west side would involve six homes, installation -of retaining walls and con-
<br />siderable
<br />on-siderable grading.
<br />Mr. Williams stated that Staff is recommending that no sidewalks be required on Mr. Rogers'
<br />street, but with the contemplated expansion of his house, he would be required to install
<br />the curb and gutter, moving it back 4 feet from the existing asphalt berm. Mr. Williams said
<br />the same requirement would apply with the remainder of the sub -division where there is asphalt
<br />berm, in the event the property owner desired to do any kind of expanding.
<br />Mr. Williams advised that no other sections of the streets would have to be widened at this
<br />point.
<br />Mr. Williams said that if Council concurs with Staff's recommendation, the action necessary
<br />is first reading of an ordinance to amend Ordinance No. 1449, which would apply only to
<br />Tract No. 6610.
<br />Mr. Donald Rogers, 11851 Myrtlewood, Colton, stated he feels as though he is paying for
<br />someone a is es sins in this particular situation with this tract, which is not actually
<br />limited to his parcel alone.
<br />Mr. Rogers continued that approximately half of the tract does not contain curbs and gutters,
<br />and the tract was not developed by the property owners. Mr. Rogers said the City accepted
<br />the tract as it was from the County.
<br />Mr. Rogers discussed portions of the City's present ordinance regarding subdivisions and
<br />off-site improvements, and stated he is in sympathy with the need for concrete curbs and
<br />gutters in this subdivision, he feels that something needs to be done about it, and he feels
<br />that the City does owe some responsibility in this area.
<br />Councilwoman Spragins stated that when this area of Reche Canyon was annexed into the City,
<br />the City of Colton accepted the tract as is, and it was the County's " "faux pas" with the
<br />development of the tract, not the City's.
<br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and passed, first reading
<br />of Ordinance No. 1467 was approved, and further reading waived.

<br />5(a) OF ORDINANCE NO. 1449, UNIFORM BUILDING CODE, 1973�EDITION, WAIVER
<br />OF SIDEWALK REQUIREMENTS FOR TRACT NO. 6610.
<br />Mr. Jack Davis, 11868 Myrtlewood, Colton, s tated his main complaint is the fact that the City
<br />intends to widen their street by 4 feet. Mr. Davis said the City is not really maintaining
<br />what they have up there now - the asphalt berm is cracked and falling apart, the street has
<br />never been sealed off and there is grass growing up in between the cracks in the road.
<br />Mr. Davis said to widen the street at this point seems to be additional expense for the City
<br />that is not really necessary, as none of the property owners in the area are in agreement
<br />with the street widening
<br />Mr. Davis asked the City Manager who owns and maintains the asphalt berm along the streets in
<br />that area.
<br />City Manager Huffaker stated that the curb and gutter, and parkway trees: are maintained by
<br />the City, and the street widening will not involve removal of the larger trees, only three
<br />small trees.
<br />Mr. Davis said he feels the City should have a better maintenance program for those streets,
<br />and take better care of that area.
