<br />Band Review
<br />City Manager Huffaker referred to a letter dated August 12, 1976, from Mr. Duane L. Sharp, Review Director of
<br />the Colton Invitational Band Review Committee, requesting that the City of Colton again sponsor the fourth annual
<br />Colton Invitational Band Review, to be held on Saturday, October 16, 1976.
<br />Moved by Councilman Rehrer, seconded by Councilman Hayes, to approve City of Colton's sponsorship of fourth annual
<br />Colton Invitational Band Review on Saturday, October 16, 1976. Vote was unanimous.
<br />Bicycles
<br />Benefit Bike-A-Thon
<br />Mr. Huffaker reported on a letter dated August 2, 1976, from Mr. Donald A. Slater, District Manager of the Independent
<br />Order of Foresters of San Bernardino, regarding the Southern California "Forester 500" Benefit Bike-A-Thon, to be
<br />held August 21 through 28, 1976, with a designated route through the City of Colton.
<br />Mr. Huffaker stated the Order is requesting the City Council's authorization and endorsement for the local project,
<br />which will benefit the Lung Associations of San Bernardino and Riverside Counties.
<br />Mayor Beltran questioned the exact route that will be used through the City of Colton.
<br />Police Chief Phil Elliott outlined the designated route through Colton, stating that bikes will be released at two
<br />locations in small groups, with nurses and flagmen being provided at various locations and intersections.
<br />Moved by Councilman Rehrer, seconded by Councilman Gonzales, to approve and endorse the Southern California "Forester
<br />500" Benefit Bike-A-Thon, August 21 through 28, 1976, at outlined. Vote was unanimous.
<br />Petition
<br />Odor Nuisance
<br />Mr. Huffaker discussed a petition that had been received August 13, 1976, containing approximately 68 signatures,
<br />requesting that the City Council investigate nauseating odors that are being emitted by Engineered Fiberglass,
<br />Inc., located at 275 South Rancho Avenue in Colton.
<br />Mr. Huffaker stated that he has discussed this problem with the plant manager, and Staff is now checking into this
<br />matter to see what can be done to resolve the problem.
<br />Mayor Beltran asked if the Air Pollution Control Board had been notified of this problem.
<br />Mr. Huffaker said no, not as yet, however, Staff intends to notify the A.P.C.D. during the coarse of their investigations.
<br />Mayor Beltran suggested that a meeting be scheduled with himself, members of the A.P.C.D., and the plant manager of
<br />Engineered Fiberglass, Inc., in an effort to resolve this serious problem and alleviate these obnoxious odors.
<br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, instructing Staff to schedule a meeting with Mayor
<br />Beltran, members of the A.P.C.D., and the plant manager of Engineered Fiberglass, Inc., to resolve the problem as
<br />outlined in the petition submitted. Vote was unanimous.
<br />Mr. Henry A. Martinez, 191 South 3rd Street, Colton, addressed the City Council, stating that he is speaking on
<br />behalf of all those persons who signed the petition and other residents in South Colton, who have been subjected to
<br />the very unpleasant and nauseating odors caused by the business known as Engineered Fiberglass, Inc. Mr. Martinez
<br />requested that the City Council give this matter their very serious and immediate attention, as these air polluting
<br />odors are definitely detrimental to the health, safety and welfare of the residents of the community.
<br />Council members assured Mr. Martinez that this problem will be taken care of.
<br />PLANNING COMMISSION REPORTS AND RFCOMMFNDAT MNO.-
<br />Conditional Use Permit

<br />Planning Director George Williams gave Staff's presentation regarding reconsideration of a Conditional Use Permit
<br />application requested by Mr. Carlton A. Post, President of Colton Country Fair, Inc., to establish the use of on-
<br />site sale of beer at a swap meet located at 2005 West Valley Boulevard, on the north side of Valley Boulevard,
<br />between Pepper and Riverside Avenues, in a C-2 zone.
<br />Mr. Williams referred to previous correspondence submitted by the applicant, including a plot plan showing the
<br />proposed snack bar, beer service and restroom area, which is to be located to the rear of the vendor sales area, a
<br />memorandum from the Chief of Police, Phil Elliott, dated July 9, 1976, and another letter dated August 9, 1976,
<br />from the applicant, together with a list of other swap meets in other areas that permit the sale of beer.
<br />Mr. Williams concluded that both the Planning Commission and Staff have recommended denial of this request, as
<br />outlined in Planning Commission Resolution No. 810.
<br />Mayor Beltran stated he would like to have something clarified, and referred to a portion of a letter submitted to
<br />the Planning Commission by Mr. Post, regarding a conversation that he had with Mr. Williams in City Hall on Thursday,
<br />June 17, 1976, which alledged that Mr. Williams had made several negative comments concerning Mr. Post's request
<br />for a Conditional Use Permit application.
<br />Mr. Williams stated this was true in part, however, not completely. Mr. Williams said he feels that it is his
<br />responsibility and a part of his job to advise any applicant of permitted uses in the City, the laws and regulations
<br />of our City's Zoning Ordinance and Municipal Code, no matter what type of proposal is involved or what type of
<br />application they are seeking. Mr. Williams further stated these applications are both time consuming and costly,
<br />to the applicant and the City as well.
<br />Mr. Williams continued that if the City permits this on-site sale of beer in this instance, a precedent will then
<br />be set, which will create undesirable situations and problems for the City. Mr. Williams reminded the Council
<br />members of the heavy traffic and pedestrians in that same area, across the street from the property in question,
<br />from the Auction which is held every Thursday and Saturday each week.
<br />Mr. Williams concluded that he still feels this should not be a permitted use at this location, and would create
<br />future hazards and problems for the City.
