0 () <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Conditional Use Permit <br />Nichols, Stewart and May <br />Planning Director Williams stated this Conditional Use Permit Application, requested by Stanley E. Nichols, <br />Douglas Stewart and Milton May, involves establishing the use of a roller skating rink, in a C2 zone, on <br />property located at 125 East F Street, the northwest corner of 9th and F Streets, south of the Civic Center. <br />Mr. Williams reviewed Staff's report regarding the proposed use, and advised that Planning Commission Resolution <br />No. 796 recommends approval of the Conditional Use Permit subject to four conditions, which he read to the <br />Council members. <br />Police Chief Phil Elliott also gave a report on other roller skating rinks in surrounding communities, Redlands, <br />Rialto, and San Bernardino and said he was told by each of the City's Police Departments that they do not have any <br />unusual or additional problems with the rinks, than any other type of recreational program or facility. <br />Mr. Stanley Nichols, applicant, stated that his partner, Mr. May, will make the presentation this evening. <br />Mr. Milton May, 127 Eucalyptus Street, Rialto, stated that he will be operating a good, safe roller skating <br />rink, well supervised, and it will not become a hang out for undesirables, as some people seem to be concerned <br />about. Mr. May said that he has operated other roller skating rinks successfully and has never had serious <br />problems with anyone. <br />Councilwoman Spragins asked the hours that the roller skating rink would be open. <br />Mr. May replied from 7:30 to 10:00 p. m., Sunday through Thursday; 7:30 to 11:30 p. m., Friday and Saturday, <br />and Saturday and Sunday afternoons. <br />Mayor Huntoon stated that although he is in favor of the roller skating rink for the youth of our community, <br />he is also concerned about the residents in the immediate area, and he would therefore recommend that a fifth <br />condition be made a part of Planning Commission Resolution No. 796, stipulating that the permit would be <br />effective for a 12 month or 18 month period, with a review at the end of that time to insure whether or not <br />the operation has been successful. <br />Mr. May advised that he is, of course, spending a great deal of money on the facility, and he is agreeable <br />with all of the conditions as stated, however, he felt that a one year period is a short span of time for all <br />that is involved. <br />The other Council members agreed that the roller skating rink would be a good type of recreational facility, <br />however, there should be a stipulation adding a time limit to the permit on this operation. <br />City Attorney Edwards suggested that a fifth condition could be added to the Conditional Use Permit, and <br />Planning Commission Resolution No. 796, as follows: <br />"At the end of fifteen (15) months of operation of the roller skating facility, <br />the City Council may institute a review of the operation. In that event, after <br />notice to the owner and a public hearing by the Planning Commission and the City <br />Council, if the City Council determines that the operation constitutes a <br />nuisance, the permit may be revoked and the operation of the roller skating <br />facility shall terminate." <br />Moved by Councilman Hayes, seconded by Councilman Gonzales, to approve Planning Commission Resolution No. 796, <br />with the five conditions as stipulated. Vote was unanimous. <br />Several opponents in the audience stated they desired to speak on the matter. <br />Mayor Huntoon stated this is not a public hearing, however, he would ask for the Council's consensus on the <br />request. <br />Council members agreed with the request. Councilman Hayes said he would withdraw his motion; Councilman <br />Gonzales said he would also withdraw his second to the motion. <br />Speaking in opposition to the roller skating rink were: <br />Mrs. Margaret Palmiri, 458 North 9th Street (submitted petition with approximately <br />Mrs. Ann Brunsmann, 453 West G Street 61 names) <br />Mrs. Jerry Evans, 436 North 9th Street <br />Two other opponents voiced their complaints against the roller rink. <br />Speaking in favor of the roller skating rink was: <br />Mrs. Sheila Rios, 820 Louise Street (submitted petition with approximately 287 names) <br />After additional discussion, Councilman Hayes moved for approval of Planning Commission Resolution No. 796, <br />with the five conditions as stipulated. <br />Motion seconded by Councilman Gonzales and unanimously passed. <br />Mayor Huntoon announced the Council would take a brief recess while the Council Chambers was being cleared. <br />Mrs. Esther Parkison, 1005 Florence Avenue, thanked the City Council for the extension of bus service to the <br />Western Avenue -Illinois Avenue area. <br />Variance <br />Floyd & Linda Smith, <br />Planning Director Williams advised the Variance application, requested by Floyd and Linda Smith, involves <br />reducing the number of required parking spaces from 25 to 16, and to delete a condition of a previous Variance <br />application, Index No. V-7-75, as stated in Planning Commission Resolution No. 789,. on property located at 460 <br />and 466 North La Cadena Drive. <br />Mr. Williams stated that Planning Commission Resolution No. 797 recommends denial of the Variance application <br />for two reasons, which he read to the Council members. <br />F E B 31976 <br />
