PLANNING COMMISSION REPORTS AND RECOMMENDATIONS:
Conditional Use Permit
Nichols, Stewart and May
Planning Director Williams stated this Conditional Use Permit Application, requested by Stanley E. Nichols,
Douglas Stewart and Milton May, involves establishing the use of a roller skating rink, in a C2 zone, on
property located at 125 East F Street, the northwest corner of 9th and F Streets, south of the Civic Center.
Mr. Williams reviewed Staff's report regarding the proposed use, and advised that Planning Commission Resolution
No. 796 recommends approval of the Conditional Use Permit subject to four conditions, which he read to the
Council members.
Police Chief Phil Elliott also gave a report on other roller skating rinks in surrounding communities, Redlands,
Rialto, and San Bernardino and said he was told by each of the City's Police Departments that they do not have any
unusual or additional problems with the rinks, than any other type of recreational program or facility.
Mr. Stanley Nichols, applicant, stated that his partner, Mr. May, will make the presentation this evening.
Mr. Milton May, 127 Eucalyptus Street, Rialto, stated that he will be operating a good, safe roller skating
rink, well supervised, and it will not become a hang out for undesirables, as some people seem to be concerned
about. Mr. May said that he has operated other roller skating rinks successfully and has never had serious
problems with anyone.
Councilwoman Spragins asked the hours that the roller skating rink would be open.
Mr. May replied from 7:30 to 10:00 p. m., Sunday through Thursday; 7:30 to 11:30 p. m., Friday and Saturday,
and Saturday and Sunday afternoons.
Mayor Huntoon stated that although he is in favor of the roller skating rink for the youth of our community,
he is also concerned about the residents in the immediate area, and he would therefore recommend that a fifth
condition be made a part of Planning Commission Resolution No. 796, stipulating that the permit would be
effective for a 12 month or 18 month period, with a review at the end of that time to insure whether or not
the operation has been successful.
Mr. May advised that he is, of course, spending a great deal of money on the facility, and he is agreeable
with all of the conditions as stated, however, he felt that a one year period is a short span of time for all
that is involved.
The other Council members agreed that the roller skating rink would be a good type of recreational facility,
however, there should be a stipulation adding a time limit to the permit on this operation.
City Attorney Edwards suggested that a fifth condition could be added to the Conditional Use Permit, and
Planning Commission Resolution No. 796, as follows:
"At the end of fifteen (15) months of operation of the roller skating facility,
the City Council may institute a review of the operation. In that event, after
notice to the owner and a public hearing by the Planning Commission and the City
Council, if the City Council determines that the operation constitutes a
nuisance, the permit may be revoked and the operation of the roller skating
facility shall terminate."
Moved by Councilman Hayes, seconded by Councilman Gonzales, to approve Planning Commission Resolution No. 796,
with the five conditions as stipulated. Vote was unanimous.
Several opponents in the audience stated they desired to speak on the matter.
Mayor Huntoon stated this is not a public hearing, however, he would ask for the Council's consensus on the
request.
Council members agreed with the request. Councilman Hayes said he would withdraw his motion; Councilman
Gonzales said he would also withdraw his second to the motion.
Speaking in opposition to the roller skating rink were:
Mrs. Margaret Palmiri, 458 North 9th Street (submitted petition with approximately
Mrs. Ann Brunsmann, 453 West G Street 61 names)
Mrs. Jerry Evans, 436 North 9th Street
Two other opponents voiced their complaints against the roller rink.
Speaking in favor of the roller skating rink was:
Mrs. Sheila Rios, 820 Louise Street (submitted petition with approximately 287 names)
After additional discussion, Councilman Hayes moved for approval of Planning Commission Resolution No. 796,
with the five conditions as stipulated.
Motion seconded by Councilman Gonzales and unanimously passed.
Mayor Huntoon announced the Council would take a brief recess while the Council Chambers was being cleared.
Mrs. Esther Parkison, 1005 Florence Avenue, thanked the City Council for the extension of bus service to the
Western Avenue -Illinois Avenue area.
Variance
Floyd & Linda Smith,
Planning Director Williams advised the Variance application, requested by Floyd and Linda Smith, involves
reducing the number of required parking spaces from 25 to 16, and to delete a condition of a previous Variance
application, Index No. V-7-75, as stated in Planning Commission Resolution No. 789,. on property located at 460
and 466 North La Cadena Drive.
Mr. Williams stated that Planning Commission Resolution No. 797 recommends denial of the Variance application
for two reasons, which he read to the Council members.
