Council members felt that inasmuch as the applicant has already begun construction, and the condition in <br />question is too restrictive for any future tenant or use, the Variance application should be approved as <br />requested. <br />Moved by Councilman Gonzales, seconded by Councilman Hayes, to over -rule the decision of Planning Commission <br />Resolution No. 797, and grant the Variance request. Vote was unanimous. <br />Redevelopment Agency <br />Planning Director Williams advised the Redevelopment Agency is requesting a loan in the amount of $1,000. to <br />purchase the alley, which runs adjacent to the present Post Office site, for completion of plans by a proposed <br />developer. <br />Moved by Councilwoman Spragins, seconded by Councilman Hayes, to authorize and approve loan in the amount of <br />$1,000. to the Redevelopment Agency as requested. Vote was unanimous. <br />Housing and Community Development Act <br />Set Public Hearing date <br />Planning Director Williams requested that the City Council set a public hearing date for discussion on the <br />Housing and Community Development Act and next year's funding for future projects. Mr. Williams suggested a <br />date of February 23, 1976. <br />This date was not agreeable with the majority of the Council members. <br />After additional discussion, the date of Wednesday, February 25, 1976, at 7:30 p. m., was agreed upon. <br />Moved by Councilman Hayes, seconded by Councilwoman Spragins, to set for public hearing on Wednesday, February <br />253 1976, at 7:30 p. m., in the Council Chambers, presentation on the Housing and Community Development Act. <br />Vote was unanimous. <br />COMM INTTY SFRVTCFS nTRFCTnR' S RFPnPTS ANn RFrnmmFNnATTnNq <br />Assessment District No. 1975-1. <br />Mr. Daniel H. Burnett, Project Engineer with Neste, Brudin and Stone, reviewed the actions and approvals taken <br />at previous hearings and meetings with regard to Assessment District No. 1975-1, Areas A and B. <br />Mr. Burnett then introduced the Attorney for the Assessment District proceedings, Mr. F. MacKenzie Brown. <br />Mr. Brown advised there are five resolutions for the City Council to consider and approve this evening, to <br />continue along with the assessment district proceedings. <br />Mr. Brown reviewed pertinent data with regard to assessment district proceedings, and stated the first item <br />for consideration will be Resolution No. 3569. <br />Moved by Councilwoman Spragins, seconded by Councilman Hayes, to approve Resolution No. 3569. Vote was unanimous. <br />RESOLUTION NO. 3569 - RESOLUTION OF THE CITY COUNCIL DESIGNATING PERSONS TO <br />PERFORM VARIOUS DUTIES FOR PROCEEDINGS IN A SPECIAL <br />ASSESSMENT DISTRICT. <br />Mr. Brown continued the next order of procedure is to approve Resolution No. 3570, ordering the construction <br />of certain public improvements in a special assessment district. <br />Moved by Councilwoman Spragins, seconded by Councilman Rehrer, to approve Resolution No. 3570. Vote was <br />unanimous. <br />RESOLUTION NO. <br />3570 - RESOLUTION OF THE CITY COUNCIL DECLARING ITS INTENTION TO <br />ORDER THE CONSTRUCTION OF CERTAIN PUBLIC IMPROVEMENTS, TO- <br />GETHER WITH APPURTENANCES AND APPURTENANT WORK IN CONNECTION <br />THEREWITH IN A SPECIAL ASSESSMENT DISTRICT; DESCRIBING THE <br />DISTRICT TO BE BENEFITED BY SAID IMPROVEMENT AND TO BE <br />ASSESSED TO PAY THE COST; AND FURTHER PROVIDING FOR THE <br />ISSUANCE OF BONDS. <br />Mr. Burnett then gave the Engineer's Report, pursuant to the Municipal Improvement Act of 1913, and referred <br />to plans and specifications, and assessment diagrams. Mr. Burnett advised the estimated cost of improvements <br />for Area A will be $47,775., and for Area B, $141,900., for a total estimated cost of $189,675. for the project. <br />Mr. Brown said it would now be in order to approve Resolution No. 3571, giving preliminary approval of the <br />report and setting a public hearing date. Mr. Brown suggested a hearing date of March 16, 1976. <br />Moved by Councilwoman Spragins, seconded by Councilman Rehrer, to approve Resolution No. 3571. Vote was <br />unanimous. <br />RESOLUTION NO. 3571 - RESOLUTION OF THE CITY COUNCIL PASSING ON THE REPORT PRESENTED <br />PURSUANT TO THE "MUNICIPAL IMPROVEMENT ACT OF 1913," GIVING <br />PRELIMINARY APPROVAL AND SETTING TIME AND PLACE FOR PUBLIC <br />HEARING. <br />Mr. Brown stated the two remaining resolutions concern the calling for bids. Mr. Brown said Resolution No. <br />3572 pertains to construction bids, which can be scheduled for opening at City Hall on Thursday, March 11, <br />1976, at 10:00 a. m. <br />Mr. Brown concluded the last Resolution, No. 3573, involves the calling for bids on bonds, which will represent <br />the unpaid assessments upon Sand in the assessment district. <br />Moved by Councilman Hayes, seconded by Councilwoman Spragins, to approve Resolution No. 3572. Vote was unanimous. <br />RESOLUTION NO. 3572 - RESOLUTION OF THE CITY COUNCIL REFERENCING PREVAILING WAGE <br />'I, SCALE, AND DIRECTING CALL FOR CONSTRUCTION BIDS. <br />Moved by Councilman Gonzales, seconded by Councilman Rehrer, to approve Resolution No. 3573.
