SL -1 AND 389 AND IMPROVEMENT <br />ZONES G AND H OF COUNTY SERVICE AREAS NOS. 38 AND 705 AND <br />IMPROVEMENT ZONE A OF COUNTY SERVICE AREA NO. 70. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Special Assessments <br />Assessment District No. 77-1 (Cooley Drive, Phase II) <br />Community Services Director Earl Young reported from his memorandum dated November 30, 1977, regarding the proposed <br />Assessment District No. 77-1 (Cooley Drive, Phase II), presenting the executed Petition for the construction of <br />street improvements in the proposed Assessment District, and Resolution No. 3751, for Council consideration and <br />approval. <br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, approving executed Petition as filed and Resolu- <br />tion No. 3751. Unanimous vote. <br />RESOLUTION NO. 3751 - RESOLUTION OF THE CITY COUNCIL MAKING FINDINGS ON WAIVER AND <br />PETITION. <br />Mr. Young continued the next item for Council consideration and approval is Resolution No. 3752, designating persons <br />to perform various duties for the proceedings in the proposed Assessment District, and a Special Counsel Agreement, <br />between the City of Colton and F. Mackenzie Brown, Attorney, for legal services and to act as bond counsel. <br />Moved by Councilman Hayes, seconded by Councilman Gonzales, to approve Resolution No. 3752, and approving and <br />authorizing Mayor and City Clerk to execute Special Counsel Agreement between the City of Colton and F. Mackenzie <br />Brown, Attorney. Unanimous vote. <br />RESOLUTION NO. 3752 - RESOLUTION OF THE CITY COUNCIL DESIGNATING PERSONS TO PERFORM <br />VARIOUS DUTIES FOR PROCEEDINGS IN A SPECIAL ASSESSMENT DISTRICT. <br />Mr. Young reported on~the proposed boundary map, showing the boundaries of the area proposed to be assessed and <br />general alignment of works of the improvements, and presented Resolution No. 3753, adopting the proposed boundary <br />map. <br />Moved by Councilman Gonzales, seconded by Councilman Hayes, to approve Resolution No. 3753. Vote was unanimous. <br />RESOLUTION NO. 3753 - RESOLUTION OF THE CITY COUNCIL ADOPTING A MAP SHOWING THE <br />GENERAL NATURE, LOCATION AND EXTENT OF THE CONSTRUCTION <br />OF CERTAIN PUBLIC WORKS OF IMPROVEMENT AND SHOWING THE <br />PROPOSED BOUNDARIES OF THE ASSESSMENT DISTRICT TO BE <br />ASSESSED FOR CERTAIN COSTS AND EXPENSES OF SAID IMPROVE- <br />MENT. <br />Mr. Young stated the last Resolution for consideration and approval is Resolution No. 3754, declaring intention to <br />order the construction of certain improvements in the proposed assessment district, and providing for the issuance <br />of bonds. <br />Moved by Councilman Gonzales, seconded by Mayor Beltran, to approve Resolution No. 3754. Vote was unanimous. <br />RESOLUTION NO. <br />3754 - RESOLUTION OF THE CITY COUNCIL DECLARING INTENTION TO ORDER <br />THE CONSTRUCTION OF CERTAIN IMPROVEMENTS TOGETHER WITH AP- <br />PURTENANCES AND APPURTENANT WORK IN CONNECTION THEREWITH IN <br />A PROPOSED ASSESSMENT DISTRICT PURSUANT TO THE TERMS AND <br />PROVISIONS OF THE "MUNICIPAL IMPROVEMENT ACT OF 1913"; DE- <br />CLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY BENE- <br />FIT AND DESCRIBING THE DISTRICT TO BE ASSESSED TO PAY THE <br />COSTS AND EXPENSES THEREOF; AND PROVIDING FOR THE ISSUANCE <br />OF BONDS. <br />Mr. Young then presented an Agreement for Council's consideration between the City of Colton and the Redevelopment <br />Agency, which provides that the Agency shall incur a debt and obligation to the City and pledge all tax incremental <br />revenues received from within the boundary of the proposed assessment district, and the Agency shall transmit all <br />available monies to the City and said tax incremental monies will be applied as outlined in the agreement. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to approve Agreement between the City of Colton and <br />the Redevelopment Agency for Assessment District No. 77-1 (Cooley Drive, Phase II), and authorizing execution by <br />Mayor and City Clerk. Vote was unanimous. <br />Mr. Young advised the last item for consideration on this matter this evening is first reading of Ordinance No. <br />1526, which provides for contribution as a credit upon assessments in Assessment District No. 77-1 (Cooley Drive, <br />Phase II). <br />Moved by Councilman Hayes, seconded by Councilman Gonzales, introducing Ordinance No. 1526 for first reading, as to <br />number and title, and waiving further reading.
