<br />Mr. Gonzales read in full Planning Commission Resolution No. 850, reviewing four conditons of approval for a
<br />Conditional Use Permit application, Index No. C-9-77, requested by Rancho Mediterrania Skateboards, Ltd., to
<br />establish a recreational skateboard park on approximately 4.5 acres of land, which will include a clubhouse,
<br />skateboard track, snack bar, spectator area, practice area, and related facilities, located on the north side
<br />of Cooley Drive, approximately one-quarter mile east of South Mt. Vernon Avenue and Cooley Drive.
<br />Moved by Councilman Hayes, seconded by Councilman Gonzales, to approve Planning Commission Resolution No. 850.
<br />Vote was unanimous.

<br />Mr. Gonzales read in full Planning Commission Resolution No. 851, outlining three conditions for approval of a
<br />Conditional Use Permit application, Index No. C-10-775 requested by Colton, Ltd., to develop a private tennis
<br />club, consisting of 20 courts, clubhouse, swimming pool, spa, teen center, child care area, parking and related
<br />facilities, on approximately 6.86 acres of land located approximately 340 feet north of Cooley Drive, approxi-
<br />mately one-quarter mile east of South Mt. Vernon Avenue and Cooley Drive.

<br />Mayor Beltran introduced Ordinance No. 1522 for second reading.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, to waive further reading of Ordinance No.
<br />1522. Vote was unanimous.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, to pass second reading and adopt Ordinance

<br />ORDINANCE NO. 1522 - AN ORDINANCE OF THE CITY OF COLTON IMPOSING A CONSTRUCTION TAX TO
<br />� Second Reading GENERATE REVENUE FOR THE CAPITAL IMPROVEMENT PARK & RECREATION
<br />FUND IPJ CONFORMANCE WITH THE RECREATION ELEMENT OF THE COLTON
<br />GENERAL PLAN.
<br />Resolution No. 3732
<br />Planning Director Gonzales introduced Resolution No. 3732 for Council's consideration and approval, outlining
<br />the fees for the construction tax as follows:
<br />1. $300 fee per dwelling unit for all residential construction.
<br />2. $250 fee for commercial or industrial construction having an estimated project
<br />valuation of $100,000 or less. A fee of two percent (2/) of the estimated project
<br />valuation for such construction having a greater estimated project valuation.
<br />3. $250 for each mobile home space created.
<br />4. $150 for each additional dwelling unit created by conversion of an existing structure.
<br />Mr. Gonzales also reported on a study taken of park fee structures in surrounding cities which indicated, in
<br />most instances, higher fees than those that Colton was recommending.
<br />Councilman Rehrer felt that with all of the existing undeveloped land in the City of Colton, these fees and
<br />the proposed Resolution would defeat our purpose for future development in the City.
<br />Councilwoman Cisneros recommended that the proposed Resolution be amended with the following changes:
<br />1. $200 fee per dwelling unit for all residential construction.
<br />2. $150 fee for commercial or industrial construction having an estimated project
<br />valuation of $100,000 or less. Two percent (2/) fee for that portion in excess
<br />of $100,000 estimated project valuation.
<br />3. $150 fee for each mobile home space created.
<br />4. $75 fee for each additional dwelling unit created by conversion of an existing
<br />structure.
<br />The following opponents addressed the City Council regarding the proposed fees and resolution, stating this
<br />will hinder the continued growth and future development in the City of Colton.

<br />After additional discussion, moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to approve Resolution
<br />No. 3732, as amended. Vote was unanimous.
<br />RESOLUTION NO. 3732 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA,
<br />ESTABLISHING FEES FOR A CONSTRUCTION TAX REQUIRED BY ORDINANCE
<br />NO. 1522 ESTABLISHING A CONSTRUCTION TAX TO GENERATE REVENUE FOR
<br />CAPITAL IMPROVEMENT PARK AND RECREATION FUND.
<br />Zoning
<br />Planning Director Gonzales reported on a previous request for a change of zone, from David McKenna, Attorney,
<br />advising that Staff met with Mr. McKenna and he is now in agreement with Staff, and does not wish to pursue
<br />the zone change as requested.

<br />City Manager Calabrese read his memorandum regarding a letter received from the City's Broker of Record, Calvert -
<br />Belden, dated October 11, 1977, requesting additional premium payment for General Liability reinsurances for the
<br />1976-77 fiscal year, in the amount of $8,558.18.
