1'7 9 <br />City Manager Calabrese reported on a letter dated November 22, 1978, from Harry <br />G. Andrews, Attorney at Law, expressing his disappointment that the City of Colton <br />has denied the Legal Clinic the privilege to carry on their legal services to the <br />community at the new Center, as they had been doing at the other Multi -Service <br />Center in South Colton. <br />Councilman Rehrer stated that no one has been denied the use of the Centers, how- <br />ever, neither Center has been opened or is ready for occupancy. <br />Mrs. Bea Hernandez, Director of the Multi -Service Center, stated she would appreciate <br />the City Council clarifying this matter, as she did not want anyone making statements <br />that the City is denying any group the use of these Centers. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Zoning <br />Ord. No. 1545 <br />Planning Director Gonzales stated the zone change request is being continued from <br />the November 7, 1978, Council Meeting and concerns a change of zone from R -E to <br />R -1-X on property located south of Barton Road, between the San Bernardino Flood <br />Control Channel and Reche Canyon Road, Montecito Memorial Park, applicant. <br />(1� Mr. Gonzales advised that the recommendation of the Planning Commission is approval <br />of Planning Commission Resolution No. 884 and proceed with Second Reading of Ordi- <br />nance No. 1545. <br />Mr. Gene McMeans, 12004 Glenwood, and Mr. Bill Lembrecht, of Westwood Avenue, spoke <br />to the City Council opposing the zone change and the proposed development, stating <br />it is very important that the City of Colton support the Reche Canyon residents in <br />their petition opposing this matter, as the County denied the residents' request op- <br />posing a similar project near Westwood Avenue and have approved the development. <br />Both opponents stressed that the residents of the Canyon want to retain the rural <br />type atmosphere and country living they now enjoy. <br />Mrs. Claire Jean Smith, 11794 Reche Canyon Road, spoke in favor of the zone change <br />and proposed development, stating that no one has the right to impede growth and <br />progress, or deny an individual the right to develop his own property. <br />Mr. Bill Truscott, Vice -President of Montecito Memorial Park, stated the proposed <br />development will not have a detrimental effect on the Canyon, and will be an asset <br />to the City. Mr. Truscott said if the Council Members had any question about the <br />development or property, he would be happy to answer them. <br />Councilman Rehrer stated that in all fairness to the developer, and in lieu of the <br />County's decision approving that development on their land, he felt this zone change <br />request and the proposed project should be approved. <br />Discussion followed among Council Members, Staff and opponents from Reche Canyon. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to waive further <br />reading of Ordinance No. 1545. Unanimous vote. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, approving Second <br />Reading and adopting Ordinance No. 1545. Upon Roll Call, the Vote was: <br />AYES: Four; Hayes, <br />NOES: One; Gonzales <br />ABSENT: None. <br />Motion carried. <br />Cisneros, Rehrer, Temby <br />ORDINANCE NO. 1545 - AN ORDINANCE OF THE CITY OF COLTON AMENDING ORDINANCE NO. 9645 <br />Second Reading AS AMENDED, AND PROVIDING FOR CERTAIN ZONE RECLASSIFICATIONS. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Agreements <br />Dial -A -Ride <br />City Manager Calabrese presented the Dial -A -Ride Agreement for Council's considera- <br />tion and approval, stating the changes as listed in Attachment "B" have been in- <br />corporated into the agreement. <br />Councilman Hayes stated that he would concur with OMNITRANS administering the Dial - <br />A -Ride program for the City of Colton, however, he would like to see added to the <br />last page of the proposed Agreement a line reading "that a further cost analysis be <br />made". <br />DECD 1978 <br />
