16 <br />RESOLUTION NO. 3771 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />SUPPORTING THE POSITION OF THE BOARD OF SUPERVISORS OF <br />SAN BERNARDINO COUNTY RELATIVE TO THE NEED FOR CONSTRUC- <br />TION OF A TUNNEL FOR ARCHIBALD AVENUE AS PART OF THE EX- <br />PANSION OF ONTARIO INTERNATIONAL AIRPORT. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Variance <br />P. C. Res. No. 863 <br />Planning Director Gonzales reported on a Variance application, Index No. <br />V-1-78, requested by Frederick George Fudge, for the division of three, <br />1 acre parcels into four 0.75 acre parcels for an -industrial project, on <br />property located on Cooley Drive, west of Mt. Vernon Avenue, between Cooley <br />Drive and Reche Canyon Channel. <br />Mr. Gonzales advised that the Planning Commission held a public hearing on <br />this matter, January 24, 1978, and recommended approval of the Variance <br />application, as outlined in Planning Commission Resolution No. 863. <br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, to approve <br />Planning Commission Resolution No. 863. Vote was unanimous. <br />Agreements <br />City of San Bernardino <br />Mr. Gonzales read his memorandum dated February 1, 1978, regarding a proposed <br />agreement with the City of San Bernardino for sewer services within Tentative <br />Tract Nos. 9967 and 9968, currently in the process of being annexed to the <br />City of Colton. <br />Mr. Gonzales advised in order for the owner/developer, Mr. A. E. Watwood, to <br />develop these tracts concurrently with his tracts in the City of Colton, he <br />will have to record the final maps on Tract Nos. 9967 and 9968 in the City of <br />San Bernardino, and the City of San Bernardino requires an agreement for sewer <br />service prior to accepting said tracts for recordation. <br />Mr. Gonzales stated that City Attorney Edwards, and the City of San Bernardino, <br />have approved the proposed agreement and Staff, therefore, requests the City <br />Council authorize the Mayor, City Clerk and City Attorney to execute said <br />agreement. <br />Councilman Rehrer was concerned that if this annexation is not approved, will <br />the City of Colton be held responsible and bound to the terms of the agreement. <br />Planning Director Gonzales stated an additional clause can be added to the <br />proposed agreement to the effect that the City of Colton would not be respon- <br />sible for services and the agreement would become null and void in the event <br />the annexation was not approved. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, approving and <br />authorizing execution of Agreement between the City of Colton and the City of <br />San Bernardino relative to Tentative Tract Nos. 9967 and 9968, with additional <br />clause as outlined by Staff. Vote was unanimous. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Assessments <br />Cooley Ranch Sewer Assessment District <br />City Manager Calabrese advised that due to land division within the Cooley <br />Ranch Sewer Assessment District, the assessment rolls and diagram need to <br />be amended, and, therefore, a resolution has been prepared for this proce- <br />dure, wherein the date of Tuesday, March 7, 1978, is set for public hearing <br />on this matter. <br />Moved by Councilman Gonzales, seconded by Councilwoman Cisneros, approving <br />Resolution No. 3767.
