regard to continuance of an established landfill operation on a site consisting <br />of approximately 28 acres located southerly of Flores and Fernando Streets, which <br />operation was to be reviewed and inspected by the California Regional Water <br />Quality Control Board and Solid Waste Management Board for compliance with. <br />the California Water Code, after which the W.Q.C.B. imposed a cease and de- <br />sist on the landfill operation, and the site was not to accept any wastes <br />until requirements were established by the Regional Water Quality Control <br />Board. <br />Mr. Gonzales advised the California Regional Water Quality Control Board will <br />not consider issuance of a permit on the operation of the landfill site until <br />all local agencies with jurisdiction have approved the use of the site for <br />the intended purpose. <br />Mr. Gonzales concluded the Planning Commission, at a meeting held October 11, <br />1977, approved the Conditional Use Permit application, subject to findings and <br />two conditions - 1) immediate prohibition of the use of Fernando and Flores <br />Streets for access to the subject property; and 2) requirement for the property <br />owner to acquire access rights furnishing protection to the existing residential <br />neighborhood along Fernando and Flores Streets from heavy truck traffic and <br />associated impacts of those operations, as outlined in Planning Commission Reso- <br />lution No. 847. <br />(y) Councilman Rehrer asked if the Regional Water Quality Control Board has now <br />given their approval of this operation. <br />Mr. Gonzales answered no, they will not consider the application until approved <br />Q by the local jurisdiction. <br />Mr. Ralph Guyaux, applicant and owner of the site, stated this property has been <br />used as a landfill site for sometime, before he purchased the property, and he <br />finds it rather ironic that the Crane Company has been dumping the very same kind <br />of materials into the County Flood Control dykes for many years. Mr. Guyaux <br />mentioned that the Water Quality Control Board has stated these materials may be <br />detrimental, not that they are detrimental. <br />Councilwoman Cisneros stated she was very concerned for the residents, especially <br />children, living on Fernando and Flores Streets, and the dangerous truck traffic <br />being created by this operation. Mrs. Cisneros suggested that the applicant try <br />to find an alternate route to the dump site. <br />Mr. Guyaux stated he is in the process of working out details with Southern <br />Pacific Railroad Company to use a portion of their right-of-way as an alternate <br />route to the dump site. <br />After additional discussion, moved by Councilwoman Cisneros, seconded by Council- <br />man Rehrer, to deny Planning Commission Resolution No. 847, and refer this matter <br />back to the Planning Commission and Staff for further review and.consideration. <br />Unanimous vote. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Right -of -Way Files <br />Community Services Director Earl Young referred to his memorandum and a letter <br />dated May 2, 1978, from Total Concepts Corporation, requesting permission to <br />encroach into the public right-of-way with a three foot high slumpstone and <br />wrought iron wall, which will front an 88 -unit apartment complex, in the <br />process of becoming condominiums under Tentative Tract No. 10280, located on <br />the north side of Washington Street. <br />Mr. Young advised the owners have indicated that they would include in the <br />Declaration of Covenants, Conditions and Restrictions that the owners would <br />maintain and remove the wall at their cost, at such time as the City deemed <br />it necessary. <br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to approve and <br />grant permission for the encroachment of a 3 -foot high wall as requested, with <br />the condition that the maintenance and removal, when necessary, be included in <br />the Covenants, Conditions and Restrictions.
