158 City Manager Calabrese reported from his memorandum regarding Council's request <br />for the cost -of removing a folding operable wall located in the senior citizens <br />room at the Lawrence A. Hutton Community Center, which will cost approximately <br />$4,500. <br />Mr. Calabrese said Staff would recommend that the wall remain in place since the <br />actual cost of the wall initially was approved by the City Council at a cost of <br />only $1,500, and it would just be a matter of not using the wall when not needed. <br />Mr. Calabrese concluded should the Council want walls in other areas and specify <br />where they want them, Staff will provide the estimates of cost for Council action. <br />Councilwoman Cisneros stated that $1,500 has already been wasted on this wall, and <br />she felt it should be removed and put in another room where it could be used. <br />Councilman Rehrer and Councilman Hayes felt that the cost to remove the wall was <br />too excessive, and agreed with Staff's recommendation. <br />After additional discussion, the -Council Members agreed that the folding operable <br />wall in the senior citizens room of the Lawrence A. Hutton Community Center be left <br />as is for the present time, and instructed Staff to investigate the possibilities <br />of utilizing the wall in another room. <br />Agreements <br />Sullivan Water Company <br />Mr. Calabrese reported to the Council Members concerning the take over of the <br />Sullivan Water Company by the City of Colton. <br />Mr. Calabrese advised there have been meetings and tours of the Sullivan Water <br />Company by the City Manager and Staff and, at this time, Staff would recommend <br />that an operations and maintenance agreement be drawn up and presented to the <br />Sullivan Water Company and City Council for approval, which agreement would be <br />on an interim basis and conditional that an assessment district be created to <br />establish funds to upgrade the Sullivan Water Company and eventual ownership <br />responsibilities by the City of Colton. <br />Mr. Calabrese recommended that the firm of Best, Best and Krieger be appointed <br />to create the assessment district and also draw up the interim operations and <br />maintenance agreement to be reviewed by our City Attorney. <br />Mr. Calabrese stated it should be understood that since part of the agreement will <br />include provisions for an assessment district and time limits in creating such a <br />district, it would naturally follow that if the agreement is not approved by both <br />parties, then the assessment district would not be created. <br />Mr. Calabrese concluded he would like direction from the City Council on this <br />matter. <br />Councilman Rehrer questioned the distribution system and asked the present condi- <br />tion of the wells. <br />Mr. Ernest Gommel, President of the Sullivan Water Company, stated the wells are <br />adequate 99 percent of the time, and they draw from the City only in extreme <br />emergencies. <br />Councilman Hayes asked what the legal ramifications would be if the City were to <br />take over this company. <br />City Attorney Edwards replied it is possible to do an assessment district. <br />Mayor Gonzales recommended that the City consider, or require, annexation of <br />those areas outside the City limits that are served by the Sullivan Water Com- <br />pany. <br />On Council consensus, Staff's recommendation to proceed with the drawing up of an <br />operation and maintenance agreement, look into assessment district funding, and <br />required annexation, was approved. <br />Peter S.
