3 4 2 Personnel <br />Finance Director <br />Mayor Gonzales read in full his memorandum dated November 29, 1979, regarding <br />Finance Director Eugene Helsley and also referred to other correspondence from <br />Mr. Helsley and City Manager Gonzales, concerning Mr. Helsley's request for a <br />Civil Service Board hearing on his pay status and reduction in salary. <br />Mayor Gonzales stated that although he was aware that Mr. Helsley was an unclassi- <br />fied employee and management status, he felt that due to past practices of the . <br />City Council of granting the City Auditor a Civil Service Board hearing, Mr. Helsley <br />should also be afforded the same privilege, as outlined in Section 5, paragraph C, <br />of Ordinance No. 1122. <br />Moved by Mayor Gonzales, seconded by Councilman Hayes, to instruct the Civil Service <br />Board to hold a public hearing as requested by Finance Director Eugene Helsley. <br />Mayor Gonzales requested a Roll Call Vote. <br />Councilman Hayes - YES <br />Councilwoman Cisneros - NO <br />Councilman Rehrer stated that before he votes he would like to ask if this will be <br />the same type of hearing that was held previously on another matter. <br />Mayor Gonzales answered yes, all of the Civil Service Board hearings are basically <br />the same, they do not deviate from one to another. <br />Councilman Rehrer asked what was the difference between the classification of <br />Auditor -Analyst and Director of Finance according to the rules that are now in <br />effect in the City. <br />Mayor Gonzales answered there is no difference in the classifications, both positions <br />are of an unclassified status and do not come under the Civil Service ordinance. <br />Councilman Rehrer stated he would have to vote NO, and would explain his vote later. <br />Councilman Temby asked for a clarification from the City Attorney on the subject <br />matter of this case as it relates to the former case and hearing. <br />City Attorney Edwards referred to the motion as made by Mayor Gonzales, and to <br />Section 5, paragraph C. of Ordinance No. 1122, which states "When requested by <br />the Council or the City Manager, the Civil Service Board shall hold hearings and <br />make recommendations on any matter of personnel administration, within the limits <br />of a request of the City Council or the City Manager." Mr. Edwards stated should <br />the motion as made by the Mayor pass, that would be the type of order that would <br />be given. <br />Councilman Temby asked if there was any similarity between the two cases. <br />City Attorney Edwards asked if Councilman Temby meant Jerry Young and Gene Helsley? <br />Mr. Edwards then stated the hearing that was held by the Civil Service Board with <br />regard to Jerry Young was under the same paragraph previously stated, pursuant to <br />Council direction. Mr. Edwards continued that the position held by Mr. Young at <br />that time was City Auditor, which position is not among the listed positions that <br />are exempted from the competitive service. Mr. Edwards said that Mr. Helsley holds <br />the position of Director of Finance which is among the positions that are listed as <br />being exempted from the competitive service. <br />Councilman Temby stated therefore, in following the rules of the City, this position <br />would not be eligible for that hearing. <br />City Attorney Edwards responded that is correct, because he is not within the com- <br />petitive service and is not entitled to the Civil Service Board hearing in the <br />manner that the normal city employee is entitled to. <br />Councilman Temby stated then he would have to vote NO. <br />Discussion was then held on the meaning of "competitive service", the existing <br />ordinance, and a proposed ordinance regarding the Civil Service System for the <br />City which was introduced at a previous Council Meeting, however, has not had <br />second reading. <br />Mayor Gonzales then asked City Clerk Ramos to continue with the Roll Call Vote: <br />DEC 41979 <br />
