278 The City Attorney was directed to write letters to both the Hal Kelley Grain &
<br />Milling Company and the Union Pacific Railroad, advising them of these complaints
<br />and requesting their assistance and support in alleviating these problems.
<br />Mr. Frank Rebollo, General Manager of the Chamber of Commerce, spoke to the Council
<br />Members regarding the Little Miss Colton contest scheduled for Saturday, July 28,
<br />1979, and advised that a letter will be sent to all officials regarding "Colton
<br />Days".
<br />Personnel
<br />Councilman Temby stated he would like a legal opinion with regard to the disciplinary
<br />action taken on employee, Jerry Young.
<br />City Attorney Edwards stated that Mr. Young had been discharged by the City Manager,
<br />effective July 5, 1979, and Mr. Young had subsequently filed an Appeal on this action
<br />with the City Clerk. Mr. Edwards stated the Personnel Officer has ruled that Mr.
<br />Young is not, as an unclassified employee, eligible to file an Appeal or have a hear-
<br />ing on this matter, however, it is his opinion, that under the ordinance, Mr. Young
<br />is in the competitive service and it would be proper for this matter to be con-
<br />sidered by the Civil Service Board.
<br />Moved by Councilman Temby, seconded by Councilman Rehrer, that the City Council
<br />request the Civil Service Board to hold a hearing and make recommendations as to
<br />the discipline imposed on Jerry Young, July 5, 1979, by the City Manager, the
<br />recommendations to include its opinion as to the severity of the discipline.
<br />Mayor Gonzales stated he is in agreement with the decision of the Personnel Officer,
<br />in that due to the fact that Mr. Young's position is of an unclassified status and
<br />he is of management personnel, he is not eligible to file an Appeal or entitled to
<br />a hearing on this matter.
<br />After additional discussion between Councilman Rehrer and Mayor Gonzales, the Mayor
<br />requested a Roll Call Vote on the motion:
<br />AYES: Three; Cisneros, Rehrer, Temby.
<br />NOES: One; Mayor Gonzales.
<br />ABSENT: One; Councilman Hayes.
<br />Motion carried.
<br />Civil Service System
<br />Ordinance No. 1122
<br />Councilman Rehrer stated he would also like to bring up a matter, relating to Ordi-
<br />nance No. 1122, Section 6, paragraph E. which he read as follows:
<br />"The positions of Administrative Assistant, Assistant to the City Manager,
<br />Auditor -Analyst, Cemetery Assistant, City Manager, Collections Supervisor,
<br />Director of Community Services, Director of Finance, Director of Planning
<br />and Special Services, Finance Assistant, General Services Supervisor, Parks
<br />and Cemetery Superintendent, Personnel Assistant and Streets and Sanitation
<br />Superintendent."
<br />Councilman Rehrer continued that these particular employees are unclassified under
<br />the City's present Ordinance, and he would like to make a motion that the City
<br />Council instruct the City Attorney to draw up an amendment to this ordinance and
<br />place everyone under the Civil Service ruling, with the exception of the position
<br />of City Manager.
<br />City Manager Calabrese advised that this is a Meet and Confer item, and suggested
<br />that it be referred to the employee associations first.
<br />City Attorney Edwards advised that he has already prepared an ordinance and it has
<br />a number, and if the Council Members liked, he would get them a copy of it. Mr.
<br />Edwards said the ordinance is ready for introduction, and if Councilman Rehrer so
<br />desires, he can do so tonight.
<br />Mr. Edwards presented Ordinance No. 1566, stating it does accomplish what Councilman
<br />Rehrer has mentioned and also contains a provision with regard to the procedure of
<br />appointment of department heads, with ratification by the City Council, and lack of
<br />ratification by the City Council on non -department head appointments.
<br />City Attorney Edwards continued he believed the Council Members received copies of
<br />his memo on this subject, dated July 3, 1979, and there is another memo dated July
<br />17, 1979, which perhaps has not as yet reached the Council Members. Mr. Edwards
