<br />it is this evening, it was.attached to a memorandum dated today.
<br />Mayor Gonzales stated this is the first time he has knowledge of the proposed Ordi-
<br />nance, and asked to see a copy of it.
<br />Mayor Gonzales stated it is his understanding that before the City Council can take
<br />action on a change involving personnel rules and regulations, it would be considered
<br />a Meet and Confer item and should be brought before the employee associations.
<br />Discussion then followed between Councilman Rehrer and Mayor Gonzales regarding the
<br />proposed amendment, Ordinance No. 1566, the existing Ordinance, No. 1122, the Meet
<br />and Confer process, and the City's Personnel System.
<br />Mr. Harold Berkebile, representing the Fire Chapter of the San Bernardino Public Em-
<br />ployees Association, stated this is the first time, as far as he knows, that anyone
<br />has mentioned changing the City ordinance, and he was sure that no one else here knew
<br />about it.
<br />Councilman Rehrer then spoke to Mr. Berkebile advising the Ordinance at the present
<br />time reads that there are unclassified employees within the City, and these employees
<br />who are unclassified are not covered by all of the rules that a Civil Service employee
<br />Qj is covered by. Mr. Rehrer continued what he is trying to do is amend the present Ordi-
<br />nance so that these particular employees will have that protection, under the Civil
<br />Service rules, by making all of the positions classified, with the exception of the
<br />position of City Manager. Mr. Rehrer concluded he is talking about the people who,
<br />at the present time, are unclassified, and to bring them under the umbrella of Civil
<br />Q Service for their protection.
<br />Mr. Berkebile concluded he is only saying that, as far as he knows, the employee
<br />associations do not know anything about this matter, and it was the City Council
<br />that approved and adopted the existing Ordinance anyway.
<br />After additional discussion, Councilman Rehrer stated he would withdraw his motion
<br />to adopt Ordinance No. 1566, as this was probably out of order, however, he would
<br />like to introduce Ordinance No. 1566 for consideration and discussion between the
<br />City and the employee associations, with their recommendations to be sent back to
<br />the City Council for action at that time.
<br />Mr. Calabrese then spoke with regard to Ordinance No. 1122, the City's Personnel
<br />Rules and Regulations, and the Civil Service System, at it pertained to the action
<br />taken by the City Council regarding the Appeal of Jerry Young, and requested that
<br />the City Clerk read the motion as made by Councilman Temby, which the City Clerk
<br />read in full.
<br />City Attorney Edwards then spoke with regard to the functions of the Civil Service
<br />Board, reading Section 5., subsection c, as follows:
<br />"The function of the Board shall be when requested by the Council or the
<br />City Manager, the Civil Service Board shall hold hearings and make recom-
<br />mendations on any matter of personnel administration, within the limits of
<br />a request of the City Council or the City Manager."
<br />City Attorney Edwards concluded the motion made by Councilman Temby falls within
<br />this catagory, therefore, it is a hearing conducted by the Board on a matter at
<br />the specific direction of the City Council.
<br />Mr. Calabrese responded then, because of that, he intends to go to the District At-
<br />torney, since there was a contribution by Mr. Young to Councilman Temby, a political
<br />contribution, which was, as he believes, the largest individual contribution, and he
<br />would also like the District Attorney to review Ordinance No. 1122 as it pertains to
<br />receiving contributions from City employees by political candidates.
<br />Councilwoman Cisneros asked if that would mean all City employees, even the City
<br />Manager?
<br />Mr. Calabrese responded it applies to everybody that contributes to a municipal
<br />election.
<br />ADJOURNMENT:
<br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros and unanimously passed,
<br />Mayor Gonzales adjourned the meeting at 8:30 p. m., to meet for an Adjourned Regular
