Mr. Gonzales stated the Planning Commission held a public hearing on the zone 249 <br />change request, April 10, 1979, and after study and research of the application <br />recommended denial of the change of zone due to five findings, as listed in <br />Planning Commission Resolution No. 908. <br />Mayor Gonzales asked if anyone desired to speak in favor of or in opposition to <br />this matter: <br />Speaking in opposition to the zone change and Appeal filed by Mr. Keith Morley <br />were the following: <br />Mr. Jess Vasquez, 677 South 8th Street, Colton - presenting the City Council with <br />photographs taken of the existing operation known as Keith & Karl's Garage. <br />Ms. Millie Herrera, 1405 Pennsylvania Avenue, Colton. <br />Mr. Joe Moreno, 479 East "N" Street, Colton - referring to Petition containing ap- <br />proximately 95 signatures in opposition. <br />Mr. Felix 0livas, 429 East "N" Street, Colton. <br />Speaking in favor of the zone change application and Appeal was the applicant's <br />attorney, Mr. Rene Jacober, advising that a portion of this property is present- <br />ly zoned M-2 and in order to be consistent, his client is requesting that the re- <br />maining portion of the property be zoned M-2, to continue the operation and <br />business. Mr. Jacober stated his client is more than willing to comply with all <br />(Y, City regulations and codes, and does not want to cause any problems or hardship <br />to the surrounding residents. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to terminate the <br />Q Public Hearing. Vote was unanimous. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, approving and <br />adopting findings as listed in Planning Commission Resolution No. 908. Vote. <br />wasunanimous. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, approving RESOLU- <br />TION NO. 3912, denying Appeal and upholding Planning Commission Resolution No. <br />908. Unanimous vote. <br />Zoning <br />P. C. Res. No. 914 <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported that no <br />protests or objections had been received. <br />Planning Director Gonzales reported on the prezoning for Annexation South 37. which <br />consists of approximately 13 acres of undeveloped land in the Reche Canyon area, <br />located south of Prado Lane and from Encanto Lane east to the City Limits. <br />Mr. Gonzales advised the prezoning of this property to R -E -X, Residential Estates <br />with Special Conditions, would be consistent with the existing City zoning through- <br />out the Canyon area. Mr. Gonzales further advised the R -E designation will limit <br />development to a maximum of two dwelling units per acre and with the "X" condition <br />additional controls, including a density control, can be recommended by the Com- <br />mission at the time of development, along with the requirement of a Conditional Use <br />Permit. <br />Mr. Gonzales concluded the Planning Commission has recommended approval of the <br />prezoning to R -E -X for Annexation South 37 as outlined -in Planning Commission <br />Resolution No. 914, and Staff recommends approval of First Reading of Ordinance <br />No. 1565. <br />Mayor Gonzales asked if anyone desired to speak in favor of or in opposition to <br />this matter. <br />Moved by Councilman Rehrer, seconded by Councilman Temby, to terminate the Public <br />Hearing. Vote was unanimous. <br />Moved by Councilman Hayes, seconded by Councilman Rehrer, to adopt First Reading <br />of Ordinance No. 1565, and waive further reading.
