322 1 have a copy of a memo dated July 12, which states the City Attorney agreed dur- <br />ing a meeting with the Finance Director and City Manager, that the 9% raise grant- <br />ed to employees was not restricted to just members of the associations but applied <br />to all permanent employees including the City Clerk and City Treasurer. My salary <br />increase as requested, plus the 9% have been paid to me retroactive to July 1st, <br />as with the other employees. <br />My feelings have always been that I work for the citizens of Colton who elected <br />me and not for the City Council, although I have always tried to work effective- <br />ly with all Department Heads and City Employees as well as with the City Council. <br />I am deeply concerned that actions are being taken with regards to my office, <br />without my having been notified and without full knowledge or consent of all <br />Council Members. If I, or anyone else, allow this type of activity to go un- <br />challenged, what will be planned next? <br />Mayor. Gonzales asked if the Council Members had comments to make. <br />City Attorney Edwards advised that the existing Ordinance, No. 829, setting the <br />salaries of the City Treasurer and City Clerk is old and the salaries therein <br />are ridiculously low, therefore, he recommends the ordinance be amended to pro- <br />vide that the salaries of the City Clerk and City Treasurer be fixed by resolu- <br />tion. <br />Mrs. Berkebile asked the City Attorney who had contacted him about a new ordi- <br />nance. <br />Mr. Edwards responded he was contacted by the City Manager's Office in this re- <br />gard. <br />Mrs. Berkebile then asked the Acting City Manager who had requested this informa- <br />tion and ordered Mr. Young to search the files. <br />Acting City Manager Elliott stated that Mr. Young works in his office and from <br />time to time he requests Mr. Young to compile certain reports and make various <br />studies, and he had instructed Mr. Young to check on the existing ordinance and <br />any other information pertaining to it. <br />Mayor Gonzales stated he recalled that at the time Jerry Young was reinstated <br />discussion was held on the salaries of the City Treasurer and City Clerk, and <br />then this matter was dropped. Mayor Gonzales continued that apparently, how- <br />ever, this was started again by investigating records of these two elected <br />officials, and for what reason he did not know. Mayor Gonzales said he does <br />not feel that a new ordinance or a resolution is necessary to fix their salaries, <br />this has already been accomplished by approving Resolution No. 3929, adopting <br />the 1979-80 Budget. Mayor Gonzales concluded that the order for this investi- <br />gation did not come from the Office of the Mayor, and he feels that legally <br />this should not have been done. <br />City Attorney Edwards again stated that Ordinance No. 829 is out -dated and the <br />salaries stated therein are ridiculously low, and that is why he suggested amend- <br />ing or repealing the old ordinance to bring it up to date. Mr. Edwards spoke <br />about laws that became effective in 1970, whereby City Clerks and City Treasurers <br />salaries could be set by ordinance or resolution, effective when adopted. <br />Councilman Rehrer stated in keeping with <br />felt the old ordinance should be up -dated <br />of these two elected officials. <br />State laws and the government code, he <br />or a new one adopted, setting the salaries <br />Moved by Councilman Rehrer, seconded by Councilman Temby, instructing the City <br />Attorney to prepare an ordinance repealing the provisions of Ordinance No. 829 <br />which fix salaries for the City Clerk and City Treasurer. <br />City Clerk Ramos said she would like to make a statement. Mrs. Ramos continued that <br />if she knew what the City Council was trying to accomplish or do, possibly she could <br />offer advice. Mrs. Ramos said there is no need to repeal or up date Ordinance No. <br />829, which sets the base salaries for the duties and responsibilities of the <br />Offices of City Clerk and City Treasurer as defined and in compliance with the <br />Government Code. Mrs. Ramos stated supplemental salary increases, for the City <br />Clerk and City Treasurer, have always been handled by resolutions for any additional <br />duties and responsibilities performed by their respective offices, for example as <br />outlined in Resolution No. 3414, adopted by the City Council in <br />1974,Goverand prepared <br />by former City Attorney Larry Hutton. Mrs. Ramos concluded t <br />Code <br />clearly defines the statutory duties and responsibilities of her office and the <br />compensation therefor, as set by ordinance. Mrs. Ramos stated consequently, there <br />was no need for a new ordinance, however, Ordinance No. 829 could be repealed. <br />OCT 2 1979 <br />
