310 Mr. Gonzales stated the Council Members have copies of a memorandum dated August <br />15, 1979, outlining the proposed amendments to Ordinance No. 1450, and also as <br />stated in Ordinance No. 1569, the major changes being in setback requirements. <br />Mayor Gonzales asked if anyone desired to speak on this matter. <br />Moved by Councilman Temby, seconded by Councilwoman Cisneros, to terminate the <br />Public Hearing. Unanimous vote. <br />Moved by Councilman Temby, seconded by Councilman Hayes, to pass First Reading <br />of Ordinance No. 1569, and waive further reading. Vote was unanimous. <br />ORDINANCE NO. 1569 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMEND - <br />First Reading ING ORDINANCE NO. 1450. <br />CORRESPONDENCE: <br />Zoning <br />Mayor Gonzales read a letter from Mr. B. B. Merrell with regard to the zoning of <br />his property, located on East Valley Boulevard, Lots 19 and 20, Block 103, which <br />he believed to be an M-2 zone, and requested the Council's consideration in <br />waiving the filing fee of $150 for a zone change amendment. <br />Planning Director Gonzales read his memorandum dated August 17, 1979, advising <br />that the property in question is zoned M-1, which does not allow the storage of <br />wrecked vehicles, and which is the type of business proposed for that location. <br />Mr. Gonzales stated the storage of wrecked vehicles is allowed in an M-2 zone, <br />with a Conditional Use Permit. <br />Mr. Gonzales stated the lots in question have been researched by Staff for per- <br />mitted uses within the past twenty years and no approvals for the storage of <br />wrecked vehicles has been found. The lots in question may be used for a park- <br />ing lot, but cannot be used to store wrecked vehicles, and a zone change does <br />not seem to be feasible since the property faces Valley Boulevard and the sur- <br />rounding uses are commercial or light manufacturing. <br />Mr. B. B. Merrell, 1011 Valencia Drive, Colton, requested Council's considera- <br />tion and approval of his request, stating he agreed to install a block wall along <br />the front of the property, and there would be no wrecked cars on the lot, the <br />vehicles that would be parked there would be those impounded by the police and <br />for insurance purposes. <br />After additional discussion, on Council consensus, Mr. Merrell was instructed to <br />apply for the zone change amendment on the property in question and pay the filing <br />fee. <br />Chamber of Commerce <br />Mr. Elliott referred to a letter from the Chamber of Commerce regarding a request <br />for allocation of funds, recommending that this matter be referred to the next <br />Regular Council Meeting, September 18, 1979. <br />Mayor Gonzales stated the City Council will deviate from the Agenda and take <br />care of Item No. 27 at this time. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />Appeals <br />City Attorney Edwards referred to a letter from Don C. Bickley, Attorney at Law, <br />and Attorney for Colton Iron and Metal, appealing the requirement of an addition- <br />al EIR for their Conditional Use Permit application. <br />Mr. Edwards recommended this matter be set for Public Hearing for the next Regu- <br />lar Council Meeting, Tuesday, September 18, 1979. <br />Moved by Councilman Hayes, seconded by Councilman Temby, to set for Public Hearing <br />on Tuesday, September 18, 1979, at 7:30 p. m., Appeal filed by Don C.
