After additional discussion, moved by Councilman Hayes, seconded by Councilwoman c)V� <br />Cisneros, to approve Resolution No. 4017. Unanimous vote. <br />RESOLUTION NO. 4017 - RESOLUTION OF THE CITY COUNCIL DECLARING LIMITING CONDITIONS <br />FOR NEW LAND DEVELOPMENT IN WESTERN PORTION OF THE CITY OF <br />COLTON. <br />City Properties <br />Mayor Gonzales stated that Item No. 15, concerning the sale of surplus City property, <br />will be removed from the Agenda. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Dial -A -Ride <br />Acting City Manager Elliott advised that the existing Agreement between the City <br />and Yellow Checker Leasing, Inc., our Dial -A -Ride operator, provides for a term <br />ending July 1, 1980, and until a new Agreement can be reached, it is recommended <br />that the old agreement remain in effect, and approval of an extension will be <br />necessary. <br />CD Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to approve and authorize <br />(Y) execution of Extension of Agreement between the City of Colton and Yellow Checker <br />Leasing, Inc., for Dial -A -Ride services. Unanimous vote. <br />Q Classifications/Positions <br />Res. No. 4019- <br />Acting City Manager Elliott read a memorandum dated July 1, 1980, regarding the dele- <br />tion of the position of Parks and Cemetery Superintendent from the 1980-81 Budget and <br />the City's Pay and Classification Plan, resulting in the dismissal of Raymond M. Lopez <br />from employment with the City. <br />Mr. Elliott stated that approval of Resolution No. 4019-A will accomplish this deletion <br />as approved at an Adjourned Meeting held June 25, 1980. <br />Mr. Dennis A. Krueger, 529 North Euclid Avenue, Upland, stated he is an attorney rep- <br />resenting Mr. Ray Lopez, and asked that the City Council reconsider their actions <br />in this matter, and that a hearing be held before the Civil Service Board for <br />their recommendations and determination. <br />Moved by Councilman Hayes, seconded by Councilwoman Garcia, to approve Resolution No. <br />4019-A. Motion carried, with Councilwoman Cisneros voting NO. <br />RESOLUTION NO. 4019 -A -A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ABOLISH- <br />ING THE POSITION OF PARKS AND CEMETERY SUPERINTENDENT AND DI- <br />RECTING HIS REMOVAL FROM EMPLOYMENT. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />Parks/Mini-Market <br />City Attorney Edwards read his report concerning the City's liability from the sale <br />of produce at the Mini -Market held in Municipal Park. <br />Mr. Edwards continued that suit may be brought against the City for alleged injuries <br />due to eating bad food. Mr. Edwards stated the organization conducting the sale of <br />food could purchase liability insurance coverage of $50,000, which costs approxi- <br />mately $100 per year, and the insurance policy could name the City as an added in- <br />sured, which would not only protect the City, but also the sellers themselves. <br />Mr. Edwards concluded if the Council agrees, it is suggested that evidence of such <br />insurance be required as a condition of approval of the Mini -Market in Municipal <br />Park. <br />Mr. Edwards also referred to a memorandum from Recreation Director Max Lofy dated <br />June 25, 1980 concerning the Mini -Market. <br />Councilwoman Garcia asked if this would be setting a precedent by allowing the senior <br />citizens to operate this Mini -Market in Municipal Park. <br />City Attorney Edwards answered yes, and possibly there would be other organizations <br />to follow with similar requests. <br />JUL 1 1930 <br />
