Planning Director Aguilera reported on the Appeal filed by Harbor Southwest Development, regarding the granting of a negative declara- tion, advising that the builder has proven to Staff and the Reche Canyon residents that their project will not cause traffic problems, and will alleviate some problems by straightening out a curve, widen- ing the road along their 960 foot frontage, contribute funds toward the resignalization of Reche Canyon and Barton Roads, as well as bring water and sewer closer to Canyon residents. Mr. Aguilera continued it is Staff's opinion that the Planning Com- mission's purpose -in requiring an EIR has been met by the builder and questions about traffic have been answered; therefore, Staff would recommend that the builder's Appeal be granted and that he be issued a Negative Declaration based on the traffic study. Mr. Aguilera concluded if Council concurs, it would be appropriate to approve issuing a Negative Declaration and approval of Resolution No. 4645. Mayor Pro Tem Rehrer asked if anyone present desired to speak on this matter.
