171 <br />Impaction Report <br />Police &Fire Protection <br />Mr. Michael F. Whipple, 30131 Town Center Drive, Laguna Niguel, Cali- <br />fornia, made a presentation to the Council Members with regard to pro- <br />viding police and fire protection to proposed developments by estab- <br />lishing a Mello -Roos Community Facilities District to finance a por- <br />tion of these City services to the residential developments. <br />Mr. Whipple stated in utilizing legislation pursuant to the Mello -Roos <br />Community Facilities Act of 1982, an election would be held, requiring <br />two-thirds vote of the electorate, after which a special tax can be <br />levied to pay for those police and fire services. Mr. Whipple said <br />this tax would be authorized only in those areas which are currently <br />developing to provide this protection. Mr. Whipple said there are <br />presently ten different parcels, property owners, that have expressed <br />an interest in participating in such a district. <br />Mr. Whipple stated the procedure this evening would be for the Council <br />to approve their proposal $n -c �c o,nrt rta�a,tT - $l lb �t i m g �- th-en Vo t:me,e t-, ,. w i t,h t h e <br />property owners, collect data, and develop procedures providing the <br />Oproperty owners with the legal mechanism to express their desire to <br />participate or not participate through an election. <br />LO Councilman Rios asked where and when would this voting take place and <br />0 under whose jurisdiction. <br />00 Mr. Whipple answered it would be under the City'sj urisdiction and <br />Q <br />would be conducted by the Registrar of Voters, a mailed ballot that <br />would be sent to the electorate, the designated property owners. <br />Councilman Rehrer stated he was concerned about the on-going expenses <br />and would these be covered under the Mello -Roos Act. <br />Mr. Whipple answered that was the purpose of the Act. <br />Councilwoman Garcia stated the City would still have an on-going cost <br />in manning these Stations. Mrs. Garcia said she was also concerned <br />about providing police and fire services to areas outside of the City. <br />Councilwoman Cisneros stated she would like to know if the election <br />process could be handled in-house by our City Clerk's Office. <br />After additional discussion, moved by Councilman Rehrer, seconded by <br />Councilwoman Garcia, to continue this matter to the next regular <br />Council Meeting. Unanimous vote. <br />? .( , ,3 .t 1 t, <br />Agua Mansa Enterprise Zone <br />Committees <br />City Attorney Edwards referred to a memorandum dated March 26, 1986, <br />regarding the formation of a Neighborhood Economic Advisory Committee <br />to study implementation of the South Colton specific plan area. <br />Mr. Edwards stated it is recommended each Council Member select three <br />persons from the South Colton area to make up the Committee, and sub- <br />mit these names at the next regular Council Meeting. <br />Colton Cablevision, Inc. <br />Res. No. R-44-86 <br />City Attorney Edwards reported on a request from Colton Cablevision, <br />Inc., to allow the assignment of contract as collateral security to <br />Heller -Oak Communications Finance Corporation, and another document <br />entitled Assignment of Contract as Collateral Security, which would <br />allow Colton Cablevision to receive 2.7 million dollars to be used to <br />complete the west side of Colton wiring project, plus other areas in <br />the City. <br />Mr. Edwards concluded if Council concurs with this request, adoption <br />of Resolution No. R-44-86 and approval of the contracts would be in <br />order. <br />APR 11986 <br />
