Unanimous vote. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rios, to pass <br />First Reading of Ordinance No. 0-4-86, and waive further reading. <br />Vote was unanimous. <br />ORDINANCE NO. 0-4-86 - AN ORDINANCE OF THE CITY OF COLTON AMENDING <br />(First Reading) ORDINANCE NO. 16029 AS AMENDED, AND PROVIDING <br />FOR CERTAIN ZONE RECLASSIFICATIONS. <br />Appeals <br />Res. No. R-18-86 <br />Mayor Huntoon declared the Public Hearing open, and referred to a <br />letter dated February 11, 1986, from Robert D. Coviello requesting <br />that the Appeal hearing on Index No. V-4-85, Variance application, <br />be continued as he was unable to be present. <br />Moved by Councilman Rios, seconded by Councilwoman Garcia, to con- <br />tinue the public hearing to Tuesday, March 4,1986, on Appeal filed <br />by Robert D. Coviello on Index No. V-4-85. Unanimous vote. <br />Annexations <br />Res. No. R-19-86 <br />Mayor Huntoon declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />on two letters of protest received. <br />Planning Director Aguilera advised the Council and Planning Commission <br />have taken action relating to the prezoning of the parcel of land lo- <br />cated in Reche Canyon known as Annexation South 43, as proposed by Paul <br />Shadid. Mr. Aguilera said that Staff and the Local Agency Formation <br />Commission feel the proposed annexation will eliminate county islands. <br />within the City of Colton's Sphere of Influence. <br />Mr. Aguilera continued along with Mr. Shadid's property there are two <br />smaller parcels containing a retail store and a restaurant, which are <br />both in conformance with City zoning and will not be affected by the <br />change of jurisdiction. <br />Mr. Aguilera concluded approval of Resolution No. R-19-86 will be the <br />last step in this process required by State law, and approximately <br />thirty days thereafter, LAFCO will issue a Notice of Completion. <br />Mayor Huntoon asked if anyone present desired to speak on this matter. <br />Cynthia Ludvigsen, 1839 Commercenter West, San Bernardino, stated she <br />was representing her clients, Mr. and Mrs. Stout, and they are opposed <br />to being included in this annexation, they wish to remain in the County <br />and have no desire to be annexed to the City. Mrs. Ludvigsen stated <br />her clients were never notified by LAFCO of these annexation proceed- <br />ings, or the hearing, however, they have submitted a letter to LAFCO <br />on this matter. <br />A gentleman representing Mr. Paul Shadid stated this was their first <br />knowledge of any objection or opposition to this annexation. The <br />gentleman advised that initially Mr. Shadid had requested only his <br />property be considered for annexation, however, the County included <br />the two other parcels to eliminate "islands" in the area. <br />Mrs. Ludvigsen contended that her client's property would do nothing <br />to create an island, or pocket zoning. <br />Councilman Rios asked Mrs. Ludvigsen why her clients did not want to <br />be annexed to the City. <br />Mrs. Ludvigsen replied they had no particular reason other than they <br />preferred to stay in the unincorporated area of the County. <br />FEB 18 qW6 <br />
