Mayor Gonzales recommended adoption of Resolution No. R-88-90, desig- <br />nating SANBAG as the Agency to develop this Program. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to adopt <br />Resolution No. R-88-90. Unanimous vote. <br />RESOLUTION NO. R-88-90 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON DESIGNATING THE SAN BERNARDINO COUNTY <br />TRANSPORTATION COMMISSION (SANBAG) AS THE AGENCY <br />TO DEVELOP A CONGESTION MANAGEMENT PROGRAM. <br />PUBLIC HEARINGS: <br />Agreements <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication and reported <br />that no protests or objections had been received. <br />City Manager Sotelo reported on the amended Development Agreement be- <br />tween the City of Colton and Gatlin/Berger Developments, Inc., for con- <br />struction of a quality open air shopping center, which will include a <br />Wal-Mart Department Store. <br />Mr. Sotelo advised that Staff and Legal Counsel have now completed <br />final negotiations with Gatlin/Berger Developmentst Inc.,, as to terms <br />and conditions of the Development Agreement. This amended agreement <br />is now consistent with the previously approved Disposition and Devel- <br />opment Agreement with the Redevelopment Agency. <br />Mr. Sotelo continued it has been determined that this project will have <br />a positive financial impact for the City. An Environmental Assessment <br />for this project has been completed according to the California Environ- <br />mental Quality Act in accordance with the Program EIR for the Cooley <br />Ranch Redevelopment Project. <br />Mr. Sotelo concluded Staff recommends approval of the Development Agree- <br />ment between the City of Colton and Gatlin/Berger Developments, Inc., <br />and First Reading of Ordinance No. 0-10-90. <br />Mr. Daniel Olivier, Legal Counsel, Best, Best & Krieger, advised they <br />have reached a final proposal, however, there is a change to the Develop- <br />ment Agreement that he felt the Council should be aware of. Mr. Olivier <br />advised the change is on Page 8, Section 5., at the bottom of the page, <br />Item (ii), which should be deleted and the following inserted. Mr. <br />Olivier read in full the change for that portion of the amended Develop- <br />ment Agreement. <br />Mayor Gonzales asked if anyone present desired to speak on this matter. <br />Mr. Gary Entrekin, 2951 Surfrider, Ventura, California, stated he needs <br />to have access to his property and, at this point, he is being cut off. <br />Mr. Entrekin said he would like to see the site plan before it is ap- <br />3 AVG 7 1990 <br />
