A request is sent to the County to abate the vehicle and the County <br />searches the DMV records and property owner records. <br />The County within 2 days sends notices to the property owner and <br />the vehicle owner giving them 10 days to abate or appeal. <br />If no appeal is requested the Code Enforcement Officer reinspects <br />the site after the 10th day. <br />If the vehicle problem has not been resolved, the Code Enforcement <br />Officer contacts the County for a tow truck assignment, and the <br />vehicle is removed within 48 hours. <br />The Code Enforcement Officer and a Police Officer must be present <br />at the tow site unless the vehicle is abandoned in an open-field, <br />then only.the Code Enforcement Officer needs to be present. <br />If there is an appeal requested, the Code Enforcement Officer <br />sets up a date. <br />The Appeal Board (to be created) makes any determination within the <br />authority granted by policy by the City Manager. <br />If the Appeal is upheld, no further action will result. If the <br />Appeal is denied, abatement takes place upon the date specified <br />by the Board. <br />Mr. Aguilera concluded Staff recommends waiving full reading and pass <br />First Reading of Ordinance No. 0-13-90. The Contract with the County <br />will be presented for approval at Second Reading of the Ordinance. <br />Mr. Henry Mendoza, 464 West "M" Street, stated the City should make <br />sure that this Ordinance does not hinder salvaging vehicles that are <br />being restored, or vintage type of autos for restoration, or to cite <br />people that are doing this type of work on autos. <br />After discussion among Councilmembers and Staff, moved by Councilman <br />Rios, seconded by Councilman Lofy, to waive full reading and pass First <br />Reading of Ordinance No. 0-13-90.
