Mr. Hernandez presented a list of 22 neighbors' <br />signatures who are opposing the granting of major/minor variances <br />and support the Planning Commission's Decision. Mr. Hernandez <br />urged that Mr. Davalos be made to abide by the law. <br />Mr. Sergio Trujillo, 1165 Kippy Dr., listed his concerns: The <br />building is a fire hazard; it is in close proximity to his <br />property; it is an encroachment; and, the addition could be used to <br />house another family or a large group of people. He requested that <br />the appeal be denied and the Planning Commission's ruling be <br />upheld. <br />Mr. John Longfield wondered what the argument was about. He <br />determined that distance was the only problem and everyone should <br />just let it go. <br />Mayor Gonzales asked for the ratio of completion and Community <br />Development Director Aguilera reported that the building is 75-80% <br />complete. He pointed out, if appeal is granted, that a great <br />amount of retrofitting would need to be done and that 3' or 2' <br />could not be cut off. Mayor Gonzales asked if the building was <br />plastered and Mr. Aguilera reported that the frame, windows, roof <br />and some wiring had been completed. <br />Councilman Lofy quoted from the Planning Commission Meeting Minutes <br />of January 14, 1992, wherein Mr. Aguilera stated that the addition <br />was found and determined to be illegal and a notice of correction <br />was issued. Councilman Lofy also quoted Deputy City Attorney Biggs <br />who wondered if the requirements for variance were met by the <br />application and who indicated that by allowing this particular <br />variance a privilege would be granted not allowed to other <br />properties in this area. Councilman Lofy inquired of Mr. Aguilera <br />and Ms. Biggs if there was a change of mind and they each answered <br />negatively. <br />Motion by Councilman Lofy, seconded by Councilman Rehrer to uphold <br />the Planning Commission's Decision, RESOLUTION NO. R-25-92 to Deny <br />Mr. and Mrs. Davalos' application for major/minor variances as the <br />property does not meet the guidelines. Unanimous vote. Councilman <br />Rehrer requested that the matter be sent back to the Planning <br />Commission for clarification. Mayor Gonzales informed Councilman <br />Rehrer that this motion supported the Planning Commission's <br />decision and it is conclusive. <br />RESOLUTION NO.
