Motion by Councilman Lofy, seconded by Councilman Rehrer, to <br />reappoint Mr. Richard Prieto to serve another term on the Planning <br />Commission, commencing January 1992. Unanimous vote. <br />Contract <br />Public Works Director Hutton referred to Ordinances 0-19-91 and <br />0-20-91 relating to private refuse haulers within the City. The <br />amendments contained therein did not affect the rights of the <br />existing private haulers to renew their business licenses and to <br />continue providing refuse hauling services within the City except <br />to the extent that new services or customers are involved. <br />The provisions of Ordinance No. 0-20-91 allow any authorized refuse <br />hauler to apply for a permit for operation of refuse hauling <br />services within the City. While such a permit is not required for <br />existing private haulers subject to termination in 1995, such <br />private haulers may apply for a permit to validate their existing <br />areas and to obtain whatever permit terms may be extended, or to <br />expand their area of service so long as that expansion does not <br />intrude upon areas served by existing private haulers. <br />The Municipal Code merely requires any authorized refuse hauler to <br />obtain a permit before commencement of service. As Jack's Disposal <br />Service is one of the existing private hauler's providing <br />continuous service in the City, subject to termination of its <br />existing business in the same way that all other haulers are <br />subject to such termination in April of 1995, no permit application <br />is required for its existing service area. <br />A permit may be granted for that area, however, in which case, the <br />permit conditions and terms would substitute for the five year <br />notice of termination previously given. Depending on the terms of <br />the permit, it could apply to new customers as well and could be <br />issued for a longer or shorter period than the remaining <br />termination period. <br />Staff recommended that the City Council approve issuance of a <br />permit to Jack's Disposal Service for its existing area and for any <br />new customers that may be directed to it by the City, that it <br />authorize the City Manager to execute a permit agreement setting <br />forth the terms and conditions of the permit, and that the permit <br />conditions include adherence to the City's rate and service <br />schedules and be approved by the City Attorney. <br />4 <br />JAN 2 1 1992 <br />
