Speakers shall not be allowed to yield or give their allotted time to other <br />speakers. <br />D5 IMPROPER REMARKS <br />Any person making impertinent, slanderous, or profane remarks, or who becomes unruly while <br />addressing the Council, shall be called to order by the Presiding Officer. If such conduct continues and <br />willfully disrupts the meeting, the Presiding Officer may, in accordance with Section 54957.9 and any <br />other applicable sections of the Brown Act or other federal or state laws, rules or regulations, order him <br />or her removed from the meeting room or order the room cleared. Public criticism of City policies, <br />procedures, programs or services or acts or omission of the Council shall not be deemed improper. <br />This was read from the Manual of Procedures adopted R-150-07, November 20, 2007. <br />Mayor Zamora requested to read the following as part of the record. <br />"On December the 161h of this year, IECN published opinion letters expressing concerns over <br />how the City Council Meeting was conducted on December 7th and alleging that State law and <br />free speech principles had been violated. I'd like you to be informed that those concerns and <br />allegation are unfounded and not supported by fact or public record and should not go <br />unchallenged. At no time did I or any other member of this City Council violate the Brown Act <br />or anyone's right to free speech nor did we violate any provisions of the city's Manual of <br />Procedure governing on how the City Council Meetings are to be conducted and public <br />testimony taken. A copy of the Manual of Procedures may be obtained from the City Clerk's <br />Office. These provisions are also referred to at the bottom of each Council Agenda. The <br />Manual of Procedures provides for how the City Council allows public comment in general and <br />for those items on the agenda. If the presiding officer determines it to be necessary in the interest <br />of time and the ability of this council to consider all items on its agenda, the presiding officer at <br />his/her discretion may request that a spokesperson be chosen to represent a group in order to <br />avoid repetitive comments or choose to limit the overall time of the public comment period or to <br />reduce the amount of time given to each individual during their public comment. <br />On December 7th the City Council was conducted in accordance with the procedures as outlined <br />above, it should also be noted that as a check and balance on the presiding officers discretion <br />any member of this council may make a motion to modify any decision made by the presiding <br />officer regarding these matters, it should also be noted that these rules of procedure and the <br />presiding officer prerogatives are stated at the bottom of each agenda you have. Although I can <br />understand why some individuals may have concerns on limitation of time on public comment, <br />they must also understand that the council meeting must be conducted in an orderly and efficient <br />manner if we are to properly conduct the people business.
