1 ' <br />H. "Rubbish" includes, but is not restricted to,.all nonputrescible <br />waste or debris such as paper, cardboard, grass, tree or shrub <br />trimmings, rugs, straw, clothing, wood or wood products, crockery, <br />glass, rubber, metal, plastic, and other similar materials; but <br />it shall not include construction materials, broken concrete, dirt <br />from grading, auto parts, or rocks over 2" in diameter; <br />I. "Sanitarian" Shall mean the employee charged by the City with the <br />responsibility for the enforcement of health and sanitary ordinances <br />and regulations. <br />SECTION 2. Declaration of Policy - The accumulation, collection, removal <br />and disposal of refuse must be controlled by the City for the protection of <br />the public health, safety and welfare, and to contribute toward diminution <br />of the presence of air pollutants in the City. The Council finds that, to <br />give practical effect to this policy, a comprehensive system for the periodic <br />collection, removal and disposal of refuse from all premises in the City is <br />essential and benefits all occupants are made liable for the refuse charges <br />authorized under this Ordinance. <br />SECTION 3. Unlawful to Deposit or Bury - No person shall dump, deposit, <br />place or bury in or upon any lot, land or public place, or in any water or <br />waterway, any refuse, or any deleterious or offensive substance condemned <br />by the Sanitarian of the City; provided, however, this section shall not <br />apply to any land used by the City for a disposal or reclamation site. <br />SECTION 4. Unlawful to Permit Refuse to Accumulate - Every occupant shall <br />keep his premises in a clean and sanitary condition, and shall not cause or <br />permit any garbage to accumulate on his premises for a period in excess of <br />two calendar weeks, or cause or permit any rubbish to accumulate on his <br />premises for a period in excess of two calendar weeks; provided, however, <br />that this provision shall not be construed to interfere with any occupant <br />keeping building materials upon premises during the construction, reconstruction <br />or repair of a building or structure thereon under a current, valid building <br />permit, nor with the keeping of wood neatly stacked upon such premises for <br />household use. <br />SECTION 5. Burning Garbage or Rubbish <br />A. Garbage: No garbage shall be burned under any circumstances. <br />B. Rubbish: No rubbish shall be burned except under permit issued by <br />the Fire Department, subject to approval by the Air Pollution <br />-2- <br />
