For <br />applicable positions requiring uniforms, the value of the uniform shall be <br />reported to Ca1PERS on behalf of eligible employees at $15.38 per pay <br />period in accordance with applicable Ca1PERS requirements and pursuant <br />to the Public Employees' Pension Reform Act (PEPRA). <br />H. Recognize the Union's name change from San Bernardino Public Employees Association <br />Mid -Manager Employees Unit to Teamsters, Local 1932. <br />I. Clarify in the requirements previously set forth in Article III, Section 1. Health Insurance <br />of the expired Memorandum of Understanding to include opt -out language to comply with <br />ACA requirements that employee must provide proof of other health coverage that meets <br />minimum essential value as follows: <br />Employees who provide the City with satisfactory proof of alternate group <br />health coverage comparable to the City's offered health insurance plans can <br />decline, in writing, coverage on the City's medical insurance plans. The <br />alternative health coverage must meet all requirements of the Affordable <br />Care Act (ACA) and related regulations for an eligible Opt -Out <br />Arrangement. In those instances where the employee's medical insurance <br />premium is less than the City's monthly contribution, the difference between <br />said cafeteria dollar amounts shall be provided in the form of bi-monthly <br />cash disbursements (payable 24 times per year). Cash disbursements to the <br />employee are subject to being taxed, pursuant to the appropriate tax codes. <br />The parties agree that either party may reopen negotiations during the term <br />of this MOU to consider the impact of the Affordable Care Act on the City, <br />the Association and its members - the City employees. This reopener is <br />limited to the impact of the Act and nothing else. The parties agree that <br />neither side will be required to negotiate on any other topic, including, but <br />not limited to compensation and benefits. <br />J. Clarify the employee holiday rights and requirements, as previously set forth in Article IV, <br />Section 3 — Holidays of the expired Memorandum of Understanding, to read as follows: <br />Each full-time unit member working regularly scheduled 8 -hour days shall <br />receive the following 8 hour holidays unless otherwise noted: <br />New Year's Day <br />Martin Luther King's Birthday <br />Lincoln's Birthday (to be observed as the Friday preceding Presidents' Day) <br />Presidents' Day <br />Memorial Day <br />Independence Day <br />Labor Day <br />Columbus Day <br />
