1 WHEREAS, there are no other in-place public utility facilities that are in use and <br />2 would be affected by the vacation; and <br />3 <br />4 WHEREAS, Section 8313(b) of the Streets and Highways Code and Section 65402 of <br />5 the Government Code require that any proposed vacation be reviewed for conformity with <br />6 the City's General Plan; and <br />7 <br />8 WHEREAS, the Planning Commission, on October 23, 2012, and City Council, on <br />9 December 18, 2012, have determined that this vacation is consistent with and in conformity <br />10 with the General Plan of the City of Colton; and <br />11 <br />12 WHEREAS, on February 19, 2013, the City Council adopted Resolution No. R-08-13 <br />13 ("Resolution of Intent") ratifying its prior declaration of intent on December 18, 2012 to <br />14 vacate the Vacated Area, as more particularly described in said Resolution; and <br />15 <br />16 WHEREAS, the Resolution of Intent gave notice that on the 5th day of March, 2013, <br />17 at 6:00 p.m., in the Colton City Council Chambers, the City Council would hear any and all <br />18 persons interested in or objecting to the proposed vacation of the Vacated Area; and <br />19 <br />20 WHEREAS, proper notice giving the date, time and place of the public hearing was <br />21 published in the manner prescribed by law; and <br />22 <br />23 WHEREAS, notices of the proposed vacation of the Vacated Area, stating the <br />24 purpose of the Resolution of Intent and the time and place set for the public hearing, were <br />25 posted in the Vacated Area in the manner -prescribed by law; and <br />26 <br />27 WHEREAS, on March 5, 2013, at 6:00 p.m. in the City Council Chambers, the City <br />28 Council heard any and all persons interested in or objecting to the proposed vacation of <br />said portions of the public right-of-way. 4 <br />
