8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Colton Ordinance No. 0-15-16 <br />time all persons wishing to testify in connection with the application were heard and the modified <br />application was comprehensively reviewed; and <br />WHEREAS, the staff reports accompanying this ordinance is found to be true, adopted as <br />Findings and incorporated in this resolution; and <br />WHEREAS, pursuant to the Guidelines for the California Environmental Quality Act <br />("CEQA"), an Initial Study prepared to assess environmental impacts of the project has determined <br />that the project would not create any significant adverse impacts on the environment and, therefore, <br />a Negative Declaration (ND) has been prepared, and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />ORDAIN AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. The City Council hereby adopts the recitals and <br />findings set forth above and in the agenda report prepared in connection with this Ordinance. <br />SECTION 2. General Plan Consistency. Based on the entire record before the City <br />Council and all written and oral evidence presented, including the staff report and the findings made <br />in this Ordinance, the City Council hereby finds and determines that the proposed Ordinance is <br />consistent with the goals and policies of the City of Colton General Plan, or will be consistent upon <br />the concurrent adoption of an Amendment to the General Plan, and is reasonably related to the <br />public welfare of the citizens of the City and surrounding regions. Specifically, the provisions of <br />this Ordinance implement General Plan policies and/or reclassifies properties into appropriate <br />zoning classifications, which will be consistent with new general plan land use designations, which <br />furthers the City's goals and policies as set forth in the City of Colton General Plan, specifically: <br />o Policy LU -1.1: "Ensure that all new development conforms to all appreciable provisions of <br />the General Plan and Zoning Code." <br />The proposed SDA Expansion will require a discretionary review (conditional use permit) <br />by the Planning Commission for development and uses. The review of conditional use <br />permits includes adoption of findings that confirm consistency with the General Plan and <br />Zoning Code. The General Plan Update Follow -Up will be consistent with a concurrent <br />approval of an Amendment to the General Plan to provide consistency between the General <br />Plan and the Zoning Code. <br />o Policy LU -1.6: "Ensure that new development projects are compatible with permitted, well- <br />maintained uses and buildings in the surrounding neighborhood or district." <br />The proposed SDA Expansion will ensure that development is compatible with surrounding <br />neighborhood through the additional discretionary (conditional use permit) review required <br />by the Planning Commission. The General Plan Update Follow -Up will reclassify <br />properties into classifications that will reduce potential impacts onto surrounding <br />neighborhoods. <br />-4- <br />
